HomeMy WebLinkAbout14934 ORD - 05/30/1979• • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, PASSED AND APPROVED ON THE 29TH DAY OF MARCH, 1961, BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY AMENDING SECTION 31-5 BY ADDING THERETO A NEW SUBSECTION, TO BE NUMBERED 31-5.22, SETTING FORTH ZONING CLASSIFICATION ON THE DESCRIBED TRACT OF LAND, WHEN ANNEXED TO THE CITY OF CORPUS CHRISTI, SAID TRACT BEING DESCRIBED AS AN 8.0+ ACRE AREA OUT OF TRACT 7, WILLIAM J. ROBERTSON FARM TRACTS, IN NUECES COUNTY, TEXAS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendment to the text of the Zoning Ordinance of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on May 30, 1979, at Regular Council Meeting of the City Council in the City Council Chambers of the City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "I-2" Light Industrial District should be granted to the tract of land hereinafter described by metes and bounds, being an 8.0+ acre tract of land, more or less. (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such con- tract contains no reference to zoning. (3) That the permanent zoning of "I-2" Light Industrial District be granted to the 8.0+ acre tract, more or less, hereinafter more fully described. 9�ea, - 1111 fl R Tom • WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565 et seq of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be, and the same is hereby, amended by making the change hereinafter set out. SECTION 2. There is hereby amended Article 31 of the Zoning Ordinance of the City of Corpus Christi, Section 31-5, by adding thereto a new subsection to be numbered Section 31-5.22, said new subsection to hereafter read as follows, such zoning classification of the hereinafter described property to be effective upon annexation: "Section 31-5.22 The following described tract of land shall be zoned and classified 'I-2' Light Industrial District: Being an irregularly shaped tract of land out of Tract 7 William J. Robertson Farm Tracts as shown by map of record in Volume 3, Page 31, Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: Beginning at a point on the southwest right-of-way line of 120.0 foot wide Saratoga Boulevard, said point being a corner in the present. City Limit line and also the most easterly corner of Lot 1, Block 7, Robertson's Farm Tract as shown by map of record in Volume 39, Pages 114 and 115, Map Records, Nueces County. Texas; Thence S. 61° 13' 15" E. along the southwest right-of-way line of said Saratoga Boulevard with the present City Limit line a distance of 725.97 feet to a point in the present City Limit line as established by City Ordinance No. 13970, for the beginning point of the tract of land herein described; -2- • • Thence continue S. 61° 13'.15" E. along the southwest right-of-way line of said Saratoga Boulevard a distance of 362.99 feet to a paint being the most easterly corner of a 10 acre tract of land whose owner of record at this time is Petroleum Electronics, Inc.; Thence S. 29° 01' 43" N. along the southeast boundary line of said 10 acre tract a distance of 600.02 feet to avoint being the most southerly corner of said 10 acre tract; Thence R. 4.61° 13'.15" W. along the southwest boundary line "of said 10 acre tract a distance of 725.98 feet to a point being the most westerly corner of said 10 acre tract; Thence N. 29° 01' 43" E. along the northwest boundary line of said 10 acre tract a distance of 346.76 feet to a point being a corner in the present City Limit line as established by above mentioned Ordinance No. 13970; Thence S. 61° 13' 15" E. along the present City Limit linea distance of 172.0 feet to a point; Thence N. 29° 01' 43" E. along the present City Limit line a distance of 253.26 feet to a point on the southwest right-of-way line of said Saratoga Boulevard; Thence S. 61° 13' 15" E. along the southwest right-of-way line of said Saratoga Boulevard and the present City Limit line a distance of35.0''feet to a point being a corner in the present City Limit line; Thence S. 29° 01' 43" of 279.25 feet to a point; Thence S. 61° 13' 15" distance of 155.99 feet to Thence N. 29° 01' 43" distance of 279.25 feet to more or less, excluding 2. previously annexed to the W. along the present City Limit line a distance E. continue along the present City Limit line a a point; E. continue along the present City Limit line a the place of beginning and containing 8.0 acres, 0 acres out of the abovementioned 10 acre tract City of Corpus Christi by Ordinance No. 13970. • • SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive.zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and fter its passage, IT IS ACCORDINGLY SO ORDAINED, this the So day of 19 71 .
