AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION FOR
A GRANT TO THE COASTAL BEND COUNCIL OF GOVERNMENTS FOR
THE TITLE V MULTIPURPOSE SENIOR CENTERS PROVIDING FUNDING
IN THE AMOUNT OF $7,970 FOR THE PURPOSE OF EXTERIOR/INTERIOR
PAINTING OF LINDALE AND GREENWOOD SENIOR CENTERS, ALL AS IS
MORE FULLY SET OUT IN THE APPLICATION, A SUBSTANTIAL COPY
OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARRED
EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL
RELATED CONTRACTS AND OTHER DOCUMENTS NECESSARY IN THE
IMPLEMENTATION OF THIS PROGRAM; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:

SECTION 1. That the City Manager be and he is hereby authorized to
submit an application to the Coastal Bend Council of Governments for Title V
Multipurpose Senior Centers, providing for funding in the amount of $7,970
for the purpose of exterior/interior painting of Lindale and Greenwood Senior
Centers, all as is more fully set out in the application, a substantial copy
of which is attached hereto and made a part hereof, marked Exhibit "A".
SECTION 2. That the City Manager is authorized to execute all
related contracts and documents necessary in the implementation of the
aforesaid program.
SECTION 3. The necessity to authorize submission of the aforemen-
tioned application for a grant for the purpose of exterior/interior painting
of Lindale and Greenwood Senior Centers at the earliest practicable date
creates a public emergency and an imperative public necessity requiring the
suspension of the Charter rule that no ordinance or resolution shall be passed
finally on the date of its introduction but that such ordinance or resolution
shall be read at three several meetings of the City Council, and the Mayor
having declared such emergency and necessity to exist, having requested the
suspension of the Charter rule and that this ordinance be passed finally on
the date of its introduction and take effect and be in full force and effect

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.

TERMS AND CONDITIONS: It is understood and agreed by the undersigned that; 1) funds
granted as a result of this request are to be expended for the purposes set forth
herein and in accordance with all applicable laws, regulations, policies, and pro-
cedures of this State and the Administration on Aging of the U. S. Department of
Health, Education, and Welfare; 2) any proposed changes in the proposal as approved
will be submitted in writing by the applicant and upon. notification of approval by
the Area Agency on Aging shall be deemed incorporated into and become a part of this
agreement; 3) the attached Assurance of Compliance (Form AoA-441) with the Depart-
mentment of Health, Education, and Welfare Regulations issued pursuant to Title VI
of the Civil Rights Act of 1964 applies to this proposal as approved; and 4) funds
awarded by the Area Agency may be terminated at any time for violations of any terms
and requirements of this agreement. -

NARRATIVE
•
Lindale and Greenwood Senior Centers are the largest multipurpose senior
citizens' facilities existing in the region. The two centers serve over 375
meals daily. They also offer a variety of social services such as informa-
tion and referral, outreach, counseling and recreational activities to an
average of 500 senior citizens on a daily basis. Both centers are geared to
serve seniors in the immediate area as well as senior citizens living out-
side of Corpus Christi.
Lindale and Greenwood Centers were built four and one-half years ago. Since
that time they have become badly mildewed and in need of repair. Grants
received for Title VII (meals), Title (social services), and R.S.V.P.
(volunteers) are not oriented toward repair and renovation. Therefore,
there has not been sufficient funds available for repair to the buildings.
The attached estimate of the project costs is an indication of the extent of
work to be done at Lindale Center. Greenwood Center will require less ex-
tensive work.

ASSURANCE OF COMPLIANCE WITH THE DEPARTMENT OF
HEALTH, EDUCATION, AND WELFARE REGULATION UNDER
TITLE VI OF THE CIVIL RIGHTS ACT OF 1964

HEREBY AGREES' THAT it will comply with title VI of the Civil Rights Act of 1964
(P.L. 88-352) and all requirements imposed by or pursuant to the Regulation of the Department
of Health, Education, and Welfare (45 CFR Parc 80) issued pursuant to that title, to the end that,
in accordance with title VI of that Act and the Regulation, no person in the United States shall,
on the ground of race, color, or national origin, be excluded from participation in, be denied the
benefits of, or be otherwise subjected to discrimination under any program or activity for which
the Applicant receives Federal financial assistance from the Department; and HEREBY GIVES
ASSURANCE THAT it will immediately cake any measures necessary to effectuate this agree-
ment.
If any real property or structure thereon is provided or improved with the aid of Federal financial
assistance extended to the Applicant by the Department, chis assurance shall obligate the
Applicant, or in the case of any transfer of such property, any transferee, for the period during
which the real property or structure is used for a purpose for which the Federal financial assist=
ante is extended or for another purpose involving rhe provision of similar services or benefits.
If any personal property is so provided, this assurance shall obligate the Applicant for the
period during which it retains ownership or possession of the property. In all ocher cases, this
assurance shall obligate the Applicant for the period during which the Federal financial assist-
ance is extended to it by the Department.
THIS ASSURANCE is given in consideration of and for the purpose of obtaining any and all
Federal grants, loans, contracts, property, discounts or other Federal financial assistance
extended after the date hereof to the Applicant by the Department, including installment pay-
ments after such date on account of applications for Federal financial assisrance which were
approved before such date. The Applicant recognizes and agrees that such Federal financial
assistance will be extended in reliance on the representations and agreements made in this
assurance, and that the United States shall have the right to seek judicial enforcement of this
assurance. This assurance is binding on the Applicant, its successors, transferees, and assign-
ees, and the person or persons whose signatures appear below are authorized to sign this assur-
ance on behalf of the Applicant.
