HomeMy WebLinkAbout14942 ORD - 06/06/1979• vp:6/5/79:1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE DOCUMENTS NECESSARY FOR THE ACQUISITION OF ONE PARCEL OF LAND IN CONNECTION WITH THE INTERNATIONAL AIRPORT -RUNWAY 31 APPROACH LIGHT SYSTEM PROJECT, NO. 245-72-1; AUTHORIZING EMINENT DOMAIN PROCEEDINGS TO CONDEMN FEE TITLE TO THE AFORESAID PARCEL OF LAND LOCATED IN NUECES COUNTY, TEXAS, IF AGREEMENT CANNOT BE REACHED WITH THE OWNERS AND CLAIM- ANTS AS TO VALUE OF SAID PARCEL, AND DIRECTING THE CITY ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS AGAINST THE OWNERS TO CARRY OUT THE INTENTIONS OF THIS ORDINANCE; APPROPRIATING OUT OF THE NO. 245 AIRPORT BOND FUND $12,000, OF WHICH $11,000 IS FOR ACQUISITION AND $1,000 IS FOR CONTINGENCIES AND INCIDENTAL EXPENSES RELATED TO CLOSING; AND DECLARING AN EMERGENCY. • BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute documents necessary for the acquisition of one parcel of land in connection with the International Airport -Runway 31 Approach Light System Project, No. 245-72-1, said parcel and the owner thereof being as follows: Parcel 1 4.576 acres out of Tract 6, Margaret Kelly Land, owned by John H. Kelly, et al. SECTION 2. In accordance with the City Charter and the laws of the State of Texas, if agreement cannot be reached with the owners and claim- ants of the said parcel, the City of Corpus Christi does hereby order, direct and authorize that eminent domain proceedings be instituted for the purpose of acquiring the fee simple title of the above described land and premises, excluding mineral interest, for use by the City for the International Airport - Runway 31 Approach Light System Project, and for other municipal purposes, and to condemn the fee title to the aforesaid parcel or tract of land, exclud- ing mineral interest. The City Attorney is hereby authorized and directed to institute proceedings against the said property, against all persons who appear to have an interest therein, and to proceed with said condemnation suit to its final conclusion and to obtain possession and title to said property for use in the said International Airport -Runway 31 Approach Light System Project and for other municipal purposes. That there is hereby appropriated the sum of $12,000 out of the No. 245 Airport Bond Fund, of which $11,000 is for acquisition and $1,000 is for contingencies and incidental expenses related to closing. SECTION 4. The necessity to acquire the hereinabove described parcel and to appropriate the sums necessary therefor in order that the Inter- national Airport -Runway 31 Approach Light System Project may proceed without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 4 day of June, 1979.
