AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE DOCUMENTS
NECESSARY FOR THE ACQUISITION OF PARCELS 12-A AND 12-B,
OSO TREATMENT PLANT IMPROVEMENTS, PROJECT NO. 250-61-25.5;
APPROPRIATING OUT OF THE NO. 250 SANITARY SEWER BOND FUND
$3,375, OF WHICH AMOUNT $3,125 IS FOR ACQUISITION AND
$250 IS FOR INCIDENTAL COSTS RELATED TO CLOSING; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute
documents necessary for the acquisition of Parcels 12-A and 12-B, Oso Treat-
ment Plant Improvements, Project No. 250-61-25.5, said owner and parcel being
more particularly identified as follows:
PARCEL 12-A
Being a 60.00 foot by 50.00 foot tract of land out of
that certain 64.974 acre tract of land out of Lot 1,
Section 11, Flour Bluff and Encinal Farm and Garden
Tracts, a map of which is recorded in Volume A, pages
41, 42 and 43, Map Records of Nueces County, Texas;
said 64.974 acre tract recorded in Volume 875, page 388,
Deed Records of Nueces County, Texas;
Beginning at a point on the Southeast right of way line
of South Staples Street for the North corner of this
tract from which corner the North corner of said Lot 1,
Section 11, same being the North corner of said 64.974
acre tract bears North 60° 58' 00" West 40.00 feet to
a point on the existing centerline of said South Staples
Street and with said centerline, North 28° 57' 00" East
475.00 feet;
Thence South 60° 58' 00" East 60.00 feet for the East
corner of this tract;
Thence South 28° 57' 00" West 50.00 feet for the South
corner of this tract;
Thence North 60° 58' 00" West 60.00 feet to a point on
said Southeast right of way line of South Staples Street for
the West corner of this tract;
Thence North 28° 57' 00" East, along the Southeast right
of way line of South Staples Street, parallel with the
existing centerline thereof and 40.00 feet distant
therefrom, measured at right angles thereto, 50.00 feet
to the Point of Beginning.
PARCEL 12-B
Being a construction easement out of that certain 64.974
acre tract of land out of Lot 1, Section 11, Flour Bluff
and Encinal Farm and Garden Tracts, a map of which is
recorded in Volume A, Pages 41, 42, 43, Map Records of
Nueces County, Texas; said 64.974 acre tract recorded in
Volume 875, page 388, Deed Records of Nueces County, Texas;

Beginning at a point on the Southeast right of way line
of South Staples Street for the North corner of this easement
from which corner the North corner of said Lot 1, Section 11
same being the North corner of said 64.974 acre tract bears
North 60° 58' 00" West 40.00 feet to a point on the existing
centerline of said South Staples Street and with said center-
line, North 28° 57' 00" East 450.00 feet;
Thence South 60° 58' 00" East 100.00 feet for the East
corner of this easement;
Thence South 28° 57' 00" West 100.00 feet for the South
corner of this easement;
Thence North 60° 58' 00" West 100.00 feet to a point on
said Southeast right of way line of South Staples Street
for the West corner of this easement;
Thence North 28° 57' 00" East, along the Southeast right
of way line of South Staples Street, parallel with the
existing centerline thereof and 40.00 feet distant therefrom,
measured at right angles thereto, 25.00 feet for a corner
of this easement;
Thence leaving said right of way, South 60° 58' 00" East
60.00 feet for an inside corner of this easement;
Thence North 28° 57' 00" East 50.00 feet for an inside
corner of this easement;
Thence North 60° 58' 00" West 60.00 feet to a point on
said Southeast right of way line of South Staples Street
for a corner of this easement;
Thence North 28° 57' 00" East, along said Southeast right
of way line of South Staples Street, parallel with the
existing centerline thereof and 40.00 feet distant therefrom,
measured at right angles thereto, 25.00 feet to the Paint
of Beginning, containing 7,000.00 square feet of land, more
or less.
The aforesaid parcels are to be acquired from the owners, Dr. and Mrs. J.
Patrick Moran.
SECTION 2. That there is hereby appropriated out of the No. 250
Sanitary Sewer Bond Fund $3,375, of which amount $3,125 is for acquisition
and $250 is for incidental costs related to closing.
SECTION 3. That the necessity to acquire the above described
parcels in order that the Oso Treatment Plant Improvements may continue with-
out delay creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such ordi-
nance or resolution shall be read at three several meetings of the City

Council, and the Mayor having declared that such emergency and necessity exist,
having requested the suspension of the Charter rule and that this ordinance
be passed finally on the date of its introduction and take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO
ORDAINED, this the /.. day of June, 1979.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
