HomeMy WebLinkAbout14959 ORD - 06/13/1979Agit jkh:6-13-79;1st 11111, AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED UPON APPLICATION OF GUY ALEXANDER AND E. P. WILLIAMS, III BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACTS "A" AND "W" OUT OF A 4.20± ACRE PORTION OF LOT 25, SEC. 18, FLOUR BLUFF &.ENCINAC FARM & GDN. TRACTS, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "A-1" APARTMFNT HOIISF DTSTRTCT TO "B-1" NFTGHBORHOOD RUSTNFSS DTSTRTCT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Guy Alexander and E. P. Williams, III for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday June 13, 1979 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 14953 MICROFILMED JUL 0 81990 SECTION 2. That the following described Tracts "A" and "W" out of a 4.20+ acre portion of Lot 25, Section 18, Flour Bluff and Encinal Farm and Garden Tracts, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby changed from "A-1" Apartment House District to "B-1" Neighborhood Business District: BLOCK "A": Being 2.27 acres, more or less, out of a 9.15 acre tract which is part of Lot 15 , Section 18 Flour Bluff and Encinal Farm and Garden Tracts as shoran on the map in Volume A at pages 41, 42, and 43 of Nueces Cou.l y, Texas, Mao Records , said Block "A" being more particularly described as follows: Beginning at a point in the Northwest line of Rodd Field Road , said point being the Southeast oorne.r of LOT 12, BLOCK 2, Lakeview Acres as shown on he map tri Volume 14 at page 47 of Nueces County, Texas, Map Records; • Thence along and with the Northwest line of Rodd Field Road S 23°57'30" W 331.03 feat to the Southeast corner of Block "A"; Thence N 61°W 298.52 feet to the Southwest corner. of Block "A"; Thence N 28°57'30" E 331 .03 feet to the Northwest corner of Block "A"; Thence S 61° E 293.52 feet to the Northeast corner of Block "A", being the point of beginning. BLOCK "W': Being 1 .93 acres, more or less, out of a 9.15 acre tract which is part of Lot 15, Section 18 Flour Bluff and Enctnal Farm and Garden Tracts as shown on the map in Volume A at pages 41, 42, and 43 of Nueces County, Texas, Map Records, said Block "W" being more particularly described as follows: Beginning at a point in the Northwest line of Rodd Field Road lying S 28057'30" W 331.03 feet from the Southeast corner of Lot 12, Block 2 Lakeview Acres as shown on the map in Volume 14 at page 47 of Nueces County, Texas, Map Records; Thence along and with the Northwest ling of Rodd Field Road S 28°57'30" W 281 feet to the Southeast corner of Block "W"; Thence N 61° W 298.52 feet to the Southwest corner of Block "W"; Thence N 28°57'30" E 281 feet to the Northwest corner of Block "W"; Thence S 61° E 298.52 feet to the Northeast corner of Block "W", being the point of beginning. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. • • SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc— tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and a r its passage, IT IS ACCORDINGLY SO ORDAINED, this the 4 day of 19 %y ATTEST: i Secretary APPROVED: DAY OF //7 J.
