AND ERNEST M. POENISCH, JR:, BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT A AND TRACT B, BEING PORTIONS OF LOT 8 AND , LOT 14, RESPECTIVELY, W. 0. WOMACK FARM LOTS SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO"I-3" HEAVY INDUSTRIAL DISTRICT ; INALL OF THE EXISTI GEPING ORDINANCEFT ASCAM NDED;HER REPEALLINGIONS ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN . EMERGENCY. • WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Corpus Invest.. mpnts. Tnr and'Frnast M Pnenicrh.",lr,for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday ' June 20, 1979 , at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq amended from time to time, and as amended, be and the same is set out. , of the Ordinance and Resolution Records, as in particular as amended by Ordinance No. 6106, hereby amended by making the change hereinafter 14963 MICROFILMED JUL 0 S 198fY • • SECTION 2. That the hereinafter more fully described tracts, Tract "A", being a portion of Lot 8, and Tract "B", being a portion of Lot 14, W. 0. Womack Farm Lots, situated in the City of Corpus Christi, Nueces County, Texas, be and the same are hereby rezoned from "R-18" One Family Dwelling District to "I-3" Heavy Industrial District: TRACT A Being 10.864 acres of land and being all of that portion of Lot 8 of the W. 0. Womack Farm Lots east of the Texas -Mexican Railway spur to Naval Air Station conveyed by F. G. Gabriel and wife, Vera Gabriel, to Ernest M. Poenisch, Jr. and Rogers South (hereinafter referred to as Poenisch-South), by deed dated the 25th day of April, A. D. 1947, recorded. in Vol. 365, pages 1 77-1 79 of the Deed Recorch of Nueces County, Texas, to which reference is here made for all purposes, which 10.864 acres is described as follows: Beginning at a 1" iron pipe situated on the north line of the Poenisch- South tract, which pipe is also on the centerl ine of a forty feet dedicated road which road divides Lot 8 from Lot 14 of the W. 0. Womack Farm Lots; Thence, South 89° 21' 00" West, 938.79 feet to a 1" iron pipe at the centerline of the Texas -Mexican Railway spur to Naval Air Station; Thence, southeast, along the centerline of such Texas -Mexican Railway spur to a 1" iron pipe on the south line of the Poenisch-South tract; Thence, North 89° 21' 00" East, 268.57 feet, along the south line of the Poenisch-South tract to a 1" iron pipe on the centerline of the forty feet county road above mentioned; North Thence,/along the centerline of such county road above mentioned 733.47 feet to the Place of Beginning. TRACT B Being 15.281 acres of land and being all of that portion of Lot 14 of the W. 0. Womack Farm Lots conveyed by F. G. Gabriel and wife, Vera Gabriel, to Ernest M. Poenisch, Jr and Rogers South (hereinafter referred to as Poenisch-South), by deed dated the 25th day of April, A. D. 1947, recorded in Vol. 365, pages 1 77-1 79 of the Deed Records of Nueces County, Texas, to which reference is here made for all purposes, which 15.281 acres is described as follows: Beginning at a 1" iron pine on the south line of the Poenisch-South tract above referred to, which point is the centerline of a forty feet dedicated road dividing Lot 8 from Lot 14 of the W. 0. Womack Farm Lots; Thence, North 89° 21' 00" East, 907. 55 feet to a 1" iron pipe for the southeast corner of the Poenisch-South tract; Thence, South 733.47 feet to a 1" iron pipe, the northeast corner of the Poenisch-South Tract Thence, South 89b 21' 00" West, 907.55 feet to the centerline of the dedicated road above referred to; Thence, along the centerl ine of such road, North. 733.47 feet to the Place of Beginning. • • SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the f9 day of (L e_. 19 %9 ..
