AN ORDINANCE
ABANDONING A 10' UTILITY EASEMENT BETWEEN LOTS 6
AND 7 OF ROPER SUBDIVISION, SUBJECT TO THE DEDI-
CATION OF AN ALTERNATE 10' EASEMENT ALONG THE
NORTHEAST SIDE OF A PORTION OF LOT 8 AND THE REAR
OF LOTS 6, 7, AND A PORTION OF LOT 8, RECORDED IN
VOLUME 13, PAGE 37, MAP RECORDS OF NUECES COUNTY,
TEXAS, AND THE RELOCATION OF AN EXISTING WATER
LINE IN THE PRESENT EASEMENT AT THE EXPENSE OF THE
OWNER; PROVIDING FOR SEVERABILITY; AND DECLARING
AN EMERGENCY.

WHEREAS, there exists a certain 10 -foot utility easement situated
between Lots 6 and 7 of Roper Subdivision, subject to the dedication of an
alternate 10' easement along the northeast side of a portion of Lot 8 and the
rear of Lots 6, 7, and a portion of Lot 8, recorded in Volume 13, page 37,
Map Records of Nueces County, Texas, and the relocation of an existing water
line in the present easement at the expense of the owner; and
WHEREAS, it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon said easement:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the 10 -foot easement situated between Lots 6 and
7 of Roper Subdivision, in the City of Corpus Christi, Nueces County, Texas,
as shown by map or plat thereof recorded in Volume 13, Page 37, Map Records
of Nueces County, Texas, be and the same is hereby closed for public use and
every municipal purpose, and abandoned to the owners of the abutting property
in accordance with the laws of the State of Texas, and for the service and
interest of the inhabitants of the City of Corpus Christi, Texas, subject to
the relocation of the existing water line in the present easement at the
expense of the owner and the dedication of an alternate 10 -foot easement along
the northeast side of a portion of Lot 8 and the rear of Lots 6, 7 and a por-
tion of Lot 8, said alternate 10 -foot easement being more fully described as
follows:
Being an irregularly shaped tract of land for utility
easement out of Lots 6, 7, and 8, Roper Subdivision as
shown by map of record in Volume 13, Page 37, Map
Records, Nueces County, Texas, and more particularly
described by metes and bounds as follows:

Beginning at a point on the easterly boundary line of
abovementioned Roper Subdivision, said point being the
most southerly corner of said Lot 6 for the beginning
point of the tract of land herein described;
Thence N. 61° 00' 40" W. along the southerly boundary
line of said Lot 6 a distance of 10.0 feet to a point;
Thence N. 28° 59' 20" E. along a line that is 10.0 feet
westerly of and parallel to the easterly boundary line
of said Lot 6, pass the common boundary line of said
Lot 6 and Lot 7 at 50.0 feet, pass the common boundary
line of said Lot 7 and Lot 8 at 100.0 feet, in all a
distance of 106.67 feet to a point;
Thence N. 61° 00' 40" W. along a line that is 6.67 feet
northerly of and parallel to the northerly boundary line
of said Lot 7 a distance of 155.15 feet to a point on
the easterly right-of-way line of 70.0 foot wide Everhart
Road;
Thence N. 28° 03' 28" E. along the easterly right-of-way
line of said Everhart Road a distance of 10.0 feet to a
point;
Thence S. 61° 00' 40" E. along a line that is 16.67 feet
northerly of and parallel to the northerly boundary line
of said Lot 7 a distance of 165.14 feet to a point on the
easterly boundary line of abovementioned Lot 8;
Thence S. 28° 59' 20" W. along the easterly boundary line
of said Roper Subdivision, pass the common easterly corner
of Lot 8 and Lot 7 at 16.67 feet, pass the common easterly
corner of said Lot 7 and Lot 6 at 66.67 feet, in all a
distance of 116.67 feet to the place of beginning and
containing 0.062 acres, more or less.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction it
shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase, word
or provision hereof be given full force and effect for its purpose.
SECTION 3. The fact that the public convenience and necessity
would be better served by the closing of the aforesaid easement creates a
public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor having
declared that such emergency and necessity exist, having requested the

suspension of the Charter rule and that this ordinance take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO
ORDAINED, this the al day of June, 1979.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
