HomeMy WebLinkAbout14969 ORD - 06/27/1979• jkh:6-19-79;1st • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF W. R. GRACE DEVELOPMENT CQRPORATION BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON PORTION OF LOTS 17 AND 18 SECTION 13 FLOUR BLUFF, TCNL TRACTS CSIUATED DTHE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R-2" MULTIPLE DWELLING DISTRICT TO "8-4" GENERAL BUSINESS DISTRICT ; INALL OTHER OF THE EXISTI GEPING ORDINANCEFT ASCAMENDED; REPEALINGIONS ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of W fZ Crara DPvPlnpmPnt Cnrpnratinn for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday June 20, 1979 , at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 149x'9 - MICROFILMED JUL 0 81980 • SECTION 2. That the zoning on the hereafter described portion of Lots 17 and 18, Section 13, Flour Bluff and Encinal Farm and Garden Tracts, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby changed from "R-2"Multiple Dwelling District to "B-4" General Business District: A tract of land containing 4.132 acres, more or less, out of Lots 17 L 18, Section 13 of Flour Bluff and Encinal Farm and Garden Tracts, a subdivision of Nueces County, Texas, as shown by the official map or plat thereof, recorded in Volume A, Page 41, 42 and 43 of the Map Re- cords of Nueces County, Texas, and being more particularly described by metes and bounds as follows: Commencing at the original Northwest corner of said Lot 17, the same being the center line of the original 40 foot wide South Staples Street (Dump Road); thence South 29° West, a distance of 220 feet to a point; thence South 61° East, a distance of 60 feet, to a point in the present Southeast right - of - way line of South Staples Street; thence South 29° West along the present Southeast right - of - way line of South Staples Street, a distance of 660 feet to a point; thence South 61° East, parallel with the Southwest boundary line of said lot 17, a distance of 900 feet to a point in said lot 18 for the Place of Beginning of the tract herein described; thence North 29° East, parallel with the South- east right - of - way line of South Staples Street, a distance of 660 feet, for the Northeast corner of this tract; thence North 61° West, parallel to the Southwest boundary line of said lots 17 6 18, a distance of 300 feet, for the Northwest corner of this tract; thence South 29° West, parallel to the Southeast right - of - way line of South Staples Street, a distance of 660 feet, for the Southwest corner of this tract; thence South 61° East a distance of 300 feet to the Place of Beginning. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT ISS ACCCCORDINGLY SO ORDAINED, this the 2 day of QC,v/I_42 19 ATTEST: Ci Secretary MANOR HE CITY F CORPUS CHRISTI, TEXAS APPROVED: 27 DAY OF J. BRUCE AYCOC ` CITY ATTORNEY Corpus Christi, Texas %day of/ryLQ,� 9 • TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no. ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
