AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER
NOS. 1 AND 2 TO THE CONTRACT WITH ASPHALT PAVING &
CONSTRUCTION COMPANY FOR THE WASHINGTON-COLES AREA
STREET IMPROVEMENTS PROVIDING FOR CHANGES IN WATERLINE
FITTINGS, GATE VALVES AND ADDITIONAL HOT -MIX ASPHALT
LEVEL -UP TO SAM RANKIN STREET, ALL AS MORE FULLY SET
FORTH IN THE SAID CHANGE ORDERS, A SUBSTANTIAL COPY
OF EACH BEING ATTACHED HERETO AND MARKED EXHIBITS
"A" AND "B", AND MADE A PART HEREOF; APPROPRIATING
$8,400 OUT OF THE NO. 220 STREET BOND FUND FOR FUNDING
OF THE AFORESAID CHANGE ORDERS, APPLICABLE TO PROJECT
NO. 220-77-2.4, WASHINGTON-COLES AREA STREET IMPROVE-
MENTS; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute Change Order Nos. 1 and 2 to the contract with Asphalt Paving &
Construction Company for the Washington -Coles Area Street Improvements
providing for changes in waterline fittings, gate valves, and additional
hot -mix asphalt level -up to Sam Rankin Street, a substantial copy of said
Change Orders being attached hereto and made a part hereof, marked Exhibits
"A" and "B".
SECTION 2. There is hereby appropriated the sum of $8,400 out of
the No. 220 Street Bond Fund for funding of the aforesaid Change Orders,
applicable to Project No. 220-77-2.4, Washington -Coles Area Street Improve-
ments.
SECTION 3. The necessity to authorize execution of the said
Change Orders and appropriation of the sums aforesaid in order that the
Washington -Coles Area Street Improvements may continue without delay creates
a public emergency and an imperative public necessity requiring the suspen-
sion of the Charter rule that no ordinance or resolution shall be passed
finally on the date of its introduction but that such ordinance or resolution
shall be read at three several meetings of the City Council, and the Mayor
having declared such emergency and necessity to exist, having requested the
suspension of the Charter rule and that this ordinance be passed finally on
the date of its intrqduction and take effect and be in full force and effect

How can similar changes be avoided in the future? More research should be done prior to
construction.

Why was this change necessary? (If left off the plans and specifications, explain why.)
To prepare a smooth, level surface for the new protective membrane to be installed below
the type "D" overlay on Sam Rankin St.
How can similar changes be avoided in the future? Unavoidable due to the condition of
the street and attempts to utilize as much of the existing concrete street as possible.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
