HomeMy WebLinkAbout14973 ORD - 07/03/1979jkh:7-2-79;lst AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE DOCUMENTS NECESSARY FOR THE ACQUISITION OF PARCEL 1, INTERNATIONAL AIRPORT LAND ACQUISITION PROJECT, NO. 245-72-1; APPROPRI- ATING OUT OF THE NO. 245 AIRPORT BOND FUND $126,493.90 TO SUPPLEMENT FUNDS PREVIOUSLY APPROPRIATED BY ORDINANCE NO. 13969, PASSED AND APPROVED ON OCTOBER 5, 1977, WITH A TOTAL ACQUISITION COST FOR THIS PARCEL OF $352,398.38, OF WHICH $350,613 IS FOR ACQUISITION AND $1,785.38 IS FOR INCIDENTAL EXPENSES RELATED TO CLOSING; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute documents necessary for the acquisition of Parcel 1, International Airport Land Acquisition Project, No. 245-72-1, from the owners, Joseph (Joe) Peter Kocurek, et al, said parcel being more fully described as follows: Parcel 1 Being an irregularly shaped parcel of land out of Share 1, First Tract, as shown in Bockholt Partition, Cause No. 791 in the District Court, Falls County, Texas„a certified copy of which is recorded in Volume 130, Page 200, Deed Records, Nueces County, Texas, said parcel being more particularly described by metes and bounds as follows: Beginning at a point in the centerline of 60 foot wide Bockholt Road, said point being the Southwest corner of a- bovementioned Share 1, Tract 1, Bockholt Partition, for the beginning point of the parcel of land herein described; Thence N. 01° 01' 29” W., along the centerline of said . SECTION 2. That there is hereby appropriated out of the No. 245 Airport Bond Fund the sum of $126,493.90 to supplement funds previously appropriated by Ordinance No. 13969, passed and approved on October 5, 1977, with a total acquisition cost for the parcel of $352,398.38, of which sum $350,613 is for acquisition and $1,785.38 is for incidental expenses related to closing. SECTION 3. The necessity to authorize acquisition of the aforesaid parcel and appropriation of sums necessary to effect such acquisition at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect -2- and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of July, 1979. TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
