HomeMy WebLinkAbout15006 ORD - 07/25/1979�vpT)24�79:1st AN ORDINANCE CLOSING AND ABANDONING THE FIVE-FOOT (5') UTILITY EASEMENT LOCATED GENERALLY BETWEEN 19TH, COLEMAN, MARY AND THE CROSSTOWN EXPRESSWAY, RUNNING ALONG THE SOUTH SIDE OF LOT 50 FROM 19TH STREET AND THE EAST SIDE OF LOT 50 TO THE RIGHT-OF-WAY OF MORRIS AVENUE, ALL AS MORE FULLY DESCRIBED HEREINAFTER, SAID ABANDONMENT TO BE SUBJECT TO REPLATTING BY THE ABUTTING OWNER THEREOF; PROVIDING FOR SEVER- ABILITY; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 5 -foot utility easement located generally between 19th, Coleman, Mary and the Crosstown Expressway, running along the South side of Lot 50 from 19th Street and the East side of Lot 50 to the right-of-way of Morris Avenue, in the City of Corpus Christi, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, more fully described hereinafter: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the 5 -foot wide utility easement located generally between 19th, Coleman, Mary and the Crosstown Expressway, running along the South side of Lot 50 from 19th Street and the East side of Lot 50 to the right- of-way of Morris Avenue, be and the same is hereby closed for public use and every municipal purpose, subject to replatting of the property by the owners thereof, and abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, said easement being more fully described as follows: Being a 5 foot wide strip of land for utility easement out of the St. Joseph Church Tract as shown by map of record in Volume 32, Page 38, Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: Beginning at a point on the east right-of-way line of Nineteenth Street, said point being the southwest corner of abovementioned St. Joseph Church Tract, for the beginning point of the tract of land herein described; Thence N. 70 23' 20" W. along the east right-of-way line of said Ninetheenth Street a distance of 5.02 feet to a point; Thence N. 88° 09' 00" E. along a line that is 5.0 feet north of and parallel to the south boundary line of said St. Joseph Church Tract a distance of 255.42 feet to a point; 15006 OROFILMED AUG 2 71980 Thence N. 02° 00' 00" W. along a line that is 5.0 feet west of and parallel to the east boundary line of said St. Joseph Church Tract a distance of 48.08 feet to an angle point; Thence N. 01° 47' 30" W. continue along a line that is 5.0 feet west of and parallel to the east boundary line of said St. Joseph Church Tract a distance of 93.50 feet to the point of intersection with the south boundary line of an existing 10.0 foot wide sanitary sewer easement; Thence N. 88° 09' 00" E. along an extension of the south boundary line of said sanitary sewer easement a distance of 5.0 feet to a point on the east boundary line of said St. Joseph Church Tract; Thence S. 01° 47' 30" E. along the east boundary line of said St. Joseph Church Tract a distance of 93.50 feet to an angle point; Thence S. 02° 00' 00" E. continue along the east boundary line of said St. Joseph Tract a distance of 53.08 feet to a point being the southeast corner of said Tract. Thence S. 88° 09' 00" W. along the south boundary line of said Tract a distance of 259.94 feet to the place of beginning and containing 0.046 acres, more or less. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or 'unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspen- sion of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the aJ-- day of July, 1979.
