HomeMy WebLinkAbout15052 ORD - 08/08/1979vp:8/7/79:1st AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF BRAND CONSTRUCTION CO., INC. BY GRANTING A SPECIAL COUNCIL PERMIT FOR PROFESSIONAL OFFICES AND GENERAL BUSINESS USES ON A PORTION OF LAND OUT OF LOTS 3 AND 4 OSO FARM TRACTS, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS MORE PARTICULARLY DESCRIBED ON THE SITE PLAN, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A", SUBJECT TO THE CONDITIONS SET FORTH HEREINAFTER; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Brand Construction Co., Inc. for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday August 8, 1979 , at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the making the change hereinafter set out. 15052 same is hereby amended by MIICROFILMED AUG 2mg SECTION 2. That a Special Permit be granted for uses permitted in "B -l" Neighborhood Business District on that portion zoned "A-2" Apartment House District and that Professional Office Buildings be approved for that portion zoned "R-2" Multiple Dwelling District with a height limitation of one-story and low profile lighting directed away from adjacent residences, in the City of Corpus Christi, Nueces County, Texas, as more particularly described on the site plan, attached hereto and made a part hereof, marked Exhibit "A", said portion of land being more particularly described below. FIELDNOTES for 7.482 acres, more -or less, out of Lots 3 G 4, Oso Farm Tracts shown by map recorded in Book A, Page 49 of the Map Records of Nueces County, Texas: BEGINNING at the Northeast corner of Lot 11, Block 12, Stone - gate North Unit 2 shown by map recorded in Volume 34, 'Page 106 of said Map Records for the Southwest corner and Point of Beginning of this tract, THENCE South 60'59' East, along the Northeast boundary line of said subdivision 505.86 feet to the Southeast corner of this tract; - THENCE North 29'02' East 529.42 feet to a point in the South- west boundary line of Mark's Tract shown by map recorded in Volume 38, Page 141 of said Map Records for the Northeast corner of this tract; - THENCE North 60'58' West along said boundary line and its pro- jection 726.54 feet to the West right-of-way line of Flynn Parkway, the Southwest corner of Lot 1, Block 1, Mark's Tract shown by map recorded in Volume 37, Page 184 of said Map Records and the North- west corner of this tract;' . THENCE South 29'02' West along the proposed extension of said right-of-way line 20 feet to the point of curve of a circular curve to the left whose central angle equals 35'56'40", radius equals 322.86' and tangent equals 104.73 feet for an arc distance of 202.54 feet to the point of tangency; THENCE South 6'54'40" East 226.18 feet to the point of curve of - a circular curve to the right whose central angle equals 36'00'35", radius equals 170', tangent equals 55.25' for an arc distance of 106.84 feet to the point of tangency; THENCE South 29'05'55" West 55.04 feet to the POINT OF BEGINNING. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the property included in the Special Permit, said Special Permit will be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. -2� SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect.' SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of August 19 79 .
