TENNIS CENTER EXPANSION AND IMPROVEMENTS, AND THE SHELY STREET REALIGNMENT PROJECT, APPROPRIATING A TOTAL OF $450,000 AS FOLLOWS: $73,080 FROM THE NO. 220 STREET BOND FUND OF WHICH $69,592.45 IS FOR CONSTRUC- TION AND $3,487.55 IS FOR ADDITIONAL ENGINEERING, CON- TINGENCIES AND RELATED EXPENSES APPLICABLE TO PROJECT NO. 220-77-23, SHELY STREET REALIGNMENT; $376,920 FROM THE NO. 291 PARK BOND ($159,210 OF WHICH AMOUNT IS FROM THE BUREAU OF OUTDOOR RECREATION, HERITAGE CONSERVATION AND RECREATION SERVICE GRANT NO. 48-00605 AND $11,000 OF WHICH IS FROM THE THIRD YEAR COMMUNITY DEVELOPMENT BLOCK GRANT, NO. 162, ACTIVITY 4736, CODE'502), OF WHICH APPROPRIATION $358,607.75 IS FOR CONSTRUCTION AND $18,312.25 IS FOR ADDITIONAL ENGINEERING, CONTINGENCIES AND RELATED EXPENSES APPLICABLE TO PROJECT NO. 291-77- 7.1, H.E.B. TENNIS CENTER EXPANSION AND IMPROVEMENTS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a contract with Asphalt Paving and Construction Company for the construction of the H.E.B. Tennis Center Expansion and Improvements, and the Shely Street Realignment Project, all as more fully described in the plans and specifications and contract documents on file in the office of the City Secretary, all of which are made a part hereof by reference and according to the bid of Asphalt Paving and Construction Company, opened on the 8th day of August, 1979, said bid being the lowest and most advan- tageous to the City of Corpus Christi. SECTION 2. That there is hereby appropriated $450,000 as follows: $73,080 from the No. 220 Street Bond Fund of which $69,592.45 is for con- struction and $3,487.55 is for additional engineering, contingencies and re- lated expenses applicable to Project No. 220-77-23, Shely Street Realign- ment; $376,920 from the No. 291 Park Bond ($159,210 of which amount is from the Bureau of Outdoor Recreation, Heritage Conservation and Recreation ' Service Grant No. 48-00605 and $11,000 of which is from the Third Year Community Development Block Grant, No. 162, Activity 4736, Code 502), of which appropriation $358,607.75 is for construction and $18,312.25 is for additional engineering, contingencies and related expenses applicable to Project No. 291-77-7.1, H.E.B. Tennis Center Expansion 15061 Vblvements. SECTION 3. The necessity to authorize execution of the afore- said contract and appropriation of the funds hereinabove described, subject to approval from the Bureau of Outdoor Recreation, in order that construc- tion may be commenced and completed at the earliest practicable date creates a public emergency and an imperative public necessity requiring the sus- pension of the Charter rule that no ordinance or•resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and be in full force and effect from and after 'ts passage, IT IS ACCORDINGLY SO ORDAINED this the 0day of - � , 1979.
