HomeMy WebLinkAbout15062 ORD - 08/15/1979AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS NECESSARY TO APPLY FOR 9.25 ACRES OF FEDERAL SURPLUS PROPERTY, SPECIFICALLY AS DESCRIBED IN EXHIBIT A_ FROM THE GENERAL SERVICES ADMINISTRATION AS PUBLIC USE LAND; AND AUTHORIZING THE APPLICATION FOR SAID PROPERTY FROM THE GENERAL SERVICES AIMIINISTRATION THROUGH THE HERITAGE CONSERVATION AND RECREATION SERVICE, THE CONTIGUOUS 9.25 ACRES TO 126.97 ACRES PREVIOUSLY ACQUIRED FROM THE GEN- ERAL SERVICES ADMINISTRATION KNOWN AS RODD FIELD, LOCATED IN THE COUNTY OF NUECES, STATE OF TEXAS; CERTIFYING THE ELIGIBILITY OF THE CITY OF OORPUS CHRISTI TO RECEIVE FED- ERAL SURPLUS LAND; DESIGNATING THE CITY MANAGER AS RES- PONSIBLE OFFICER FOR THE PROJECT AND AUTHORIZING HIM TO EXECUTE ALL DOCUMENTS NECESSARY TO PAY THE ADMINISTRA- TIVE EXPENSES INCIDENT TO THE TRANSFER, AND DESIGNATING THE FINANCE DIRECTOR AS FISCAL OFFICER FOR THE PROJECT; AND DECLARING AN EMERGENCY. WHEREAS, The City Council desires to apply for the 9.25 acres of federal surplus property described as Corpus Christi Tracking Station, Rodd Field " Exhibit A for the purpose of developing an open space and recreation area, contiguous to and a part of 126.97 acres previously acquired; and WHEREAS, the City of Corpus Christi is a municipal corporation, a home rule city and a political subdivision of the State of Texas, and that application is being made under the provisions of Section 203 (K)(2) of the Federal Property and Administrative Services Act of 1949, (63 Statute 387) as amended, and rules and regulations promulgated pursuant thereto; and WHEREAS, the City of Corpus Christi has legal authority, is willing and is in a position to assume immediate care and maintenance of Corpus Christi Track- ing Station, Rodd Field; and WHEREAS, the City Council desires to designate the Director of Finance of the City of Corpus Christi as the fiscal officer for the project; and WHEREAS, the City Council desires to designate the City Manager as the responsible officer for the City for the project; and WHEREAS, the City Council desires to authorize the City Manager to execute all documents necessary to obtain the surplus properties and wishes to authorize the City Manager to pay the administrative expenses incident to the transfer; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That it is hereby determined that the City of Corpus Christi is eligible to receive Federal surplus properties from the General Seivices Admin- istration through the Heritage Conservation and Recreation Serer devel ing 35062 • Corpus Christi Tracking Station, Rodd Field, GSA Control acres, as an open space and recreation area. Number 8000-19435, 126.97 SECTION 2. That the City Manager is hereby designated as the responsible officer for the City for the aforesaid project. SECTION 3. That the City Manager is authorized to execute all documents necessary to obtain the surplus property. SECTION 4. That the City Manager is authorized to pay all administrative 1 expenses incident to the transfer of the surplus property. SECTION 5. That the Director of Finance is hereby designated as the fiscal officer for the project. SECTION 6. The necessity and urgency for immediate application for sur- plus federal properties from the General Services Administration through the Heri- 1 tage Conservation and Recreation Service as promptly as possible creates a public 1 emergency and an imperative public necessity requiring the suspension of the Charter 1 Rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect fro and after its passage, IT IS ACCORDINGLY SO the /5 -day of _„ , 1979. k / ORDAINED, this AIThST: City/Secreta APPROVED: r4 DAY OF / , 1979 J. BRUCE AYCOCK, ITY ATTORNEY Exhibit A OR f/ CITY OF CORPUS CHRISTI, TEXAS EXHIBIT A- A tract of -land situated in the County of Nueces, State of Texas, and being a portion of the former Rodd Field, Texas, later known as the NASA Tracking Station, Corpus Christi, Texas; and being all or a part of Lots 18, 19, 20, 21, 22, 26, 27, 28, 29, and 31 of Section 21, and portions of Lots 5, 6, and 7 of Section 22 of the Flour Bluff and Encinal Farm and Garden Tracts as shown by map of record in Map Book A, pages 41„ 42 and 43 of the Deed Records of Nueces County and being more particular- ly described as follows: Beginning at a point on the existing fence N 02 degrees -16' -10" W, 303.60•feet from Southeast corner of NASA (formerly Rodd Field) tract, 136.22 acres. Thence N 87 degress -40' -50" W, 790.58 feet to the Southwest corner of this tract, said point being a chisled 'X", thence N 02 degrees -14' -29" W, 512.37 feet to the Northwest corner of this tract, said point being a chisled "X", thence N 87 degrees -41'-12" E, 775.74 feet to a corner of this tract, said point being a 1/2" iron pin, thence S 02 degrees -06' -42" E, 125.51 feet to a corner of this tract, said point being a fence post, thence N 87 degrees -53' -28" E, 14.95.feet to a corner of this tract, said point being a fence post, thence S 02 degrees -16'-10" E, 386.72 feet to the point of beginning and containing 9.25 acres more or less; Corpus Christi, Texas JS day of TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas , 1919 For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally,on the date it is introduced, or at the present meeting of the City Council.
