HomeMy WebLinkAbout15069 ORD - 08/22/1979vp:8/21/79:1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO CONVEY BY SPECIAL WARRANTY DEED TO PATSY ANN BROOKS THAT TRACT OR PARCEL DESCRIBED AS tTHE .0852 ACRES OUT OF LOTS 6, 7 AND 8, BLOCK 6, BARTytOME ADDITION, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS FOR A CON- SIDERATION OF $4,100, ALL AS MORE FULLY SET FORTH IN THE SPECIAL WARRANTY DEED, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to convey by Special Warranty Deed to Patsy Ann Brooks that tract or parcel described as the .0852 acres out of Lots 6, 7 and 8, Block 6, Barthlome Addition, in the City of Corpus Christi, Nueces County, Texas, for a consider- ation of $4,100, all as more fully set forth in the Special Warranty Deed, a copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. The necessity to immediately authorize the execution of a deed in order to facilitate the sale of the above described parcel of land creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the 2 -2 --day of August, 1979. Marvin Townsend, of the County of Nueces and State of Texas for and in consideration of the sum of Four thousand one hundred ($4,100) DOLLARS to the undersigned paid by the grantee herein named, the receipt of which is hereby acknowledged, has GRANTED, SOLD AND CON- VEYED, and by these presents does GRANT, SELL AND CONVEY unto Patsy Ann Brooks, subject to the reservation hereinafter made, of the County of Nueces and State of Texas, all of the following described real property in Nueces County, Texas, to -wit: Being an.irregularly shaped tract of land out of Lots 6, 7, and 8, Block 6, Barthlome Addition as shown by map of record in Volume 4, Page 55, Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows:• Beginning at a point on the southeast right-of-way line of 80 foot wide Nueces Bay Boulevard, said point being the northwest corner of abovementioned Lot 7, for the begin- ning point of the tract of land herein described; Thence S. 89' 50'40" E. along the north boundary line of said Lots 7 and 8, pass the common back corner of said Lots 7 and 8 at 16.75 feet, in all a distance of 41.75 feet to a point; Thence S. 0' 09'20" W. a distance of 60.0 feet to a point being the southeast corner of this tract; Thence N. 89° 50'40" W., pass the common boundary line of said Lots 8 and 7 at 25.0 feet, the common boundary line of said Lots 7 and 6 at 75.0 feet, in all a distance of 82.03 feet to a point on the southeast right-of-way line of abovementioned Nueces Bay Boulevard; Thence N. 34° 02' E. along the southeast right-of-way line of said Nueces Bay Boulevard a distance of 72.27 feet to the place of beginning and containing 3713.40 square feet of land, or .0852 acres, more or less. This conveyance is made and accepted subject to the following conditions: (1) That Grantee demolish and remove the structure situated on the premises herein conveyed within six (6) months of date hereof. (2) That Grantee install a parking barrier of concrete wheel stops along the south boundary line of a 25' driveway easement, hereinafter reserved to Grantor, for a distance of 25' easterly from the east line of Lot Seven (7) to the east line of the parcel herein conveyed; thence, said parking barrier shall extend in a southerly direction along the east boundary of the tract herein conveyed for a distance of 35' to the southeast corner of the tract herein described. (3) That Grantee construct and maintain traffic signs in said driveway easement designating such driveway as a firelane and prohibiting parking or obstruction by the public. concrete (4) That Grantee construct and pave with asphaltic/material a 25' wide driveway south of and adjacent to the north lot line of lots seven (7) and eight (8), Block six (6), Barthlome Addition, extending easterly an average distance of approximately fifty (50') feet from Nueces Bay Boule- vard to the rear of Fire Station #5 site. (5) Current ad valorem taxes on said property having been prorated, the payment thereof is assumed by Grantee. TO HAVE AND TO HOLD the above described premises, together with all and singular the rights and appurtenances thereto in anywise belonging, unto the said grantee, her heirs and assigns forever; and it does hereby bind it- self, its successors and assigns to WARRANT AND FOREVER DEFEND all and singular the said premises unto the said grantee, her heirs and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof, by, through or under it but not otherwise. It is, however, understood and agreed that out of the property herein conveyed there is hereby excepted and reserved unto Grantor, its suc- cessors and assigns, the free, uninterrupted and exclusive use and easement along a certain driveway across said premises, and located along the entire north boundary of the tract herein conveyed and being 25 feet in width, ex- tending easterly from the southeasterly right-of-way line of Nueces Bay Boulevard a distance of approximately fifty (50') feet.
