HomeMy WebLinkAbout15093 ORD - 08/29/1979vp:8/28/79:1st AN ORDINANCE AMENDING TIIE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF TFIE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF TUCKER PROPERTIES BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACTS A AND B, BEING PORTIONS OF LOT 1, SECTION 8 , BOHEMIAN COLONY LANDS SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "I-2" LIGHT INDUSTRIAL DISTRICT TO "R -1B" ONE -FAMILY DWELLING DISTRICT ON TRACT A AND "B-1" _ NEIGHBORHOOD BUSINES DISTRICT ON TRACT B; KEEPING IN EFFECT ALL OTHER P OVISIONS OF THE EXISTING ORDI- NANCE AS AMENDED; EALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLAR NG AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Tucker Properties for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on August 29, 1979 , at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 0000 15093 SECTION 2. That the zoning on Tracts A and 6, being portions of Lot 1, Section 8, Bohemian Colony Lands, situated in Corpus Christi, Nueces County, Texas, more particularly described hereinafter, be and the same is hereby changed from "I-2" Light Industrial District to "R -1B" One -family Dwelling District on Tract A and "B-1" Neighborhood Business District on Tract B: TRACT A FIELDNOTES for 33.75 acres of land out of Lot 1, Section 8, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, ,lap Records of ,lueces County, Texas: BEGINNING at the point of intersection of the existing Northwest right-of-way line of Kostoryz Road and the Southwest boundary line of said Lot 1 for the South corner of this survey; THENCE North 62°31'10" West, along the Southwest boundary line of said Lot 1, 1,242.70 feet to a S inch iron pipe found for the West corner of this survey; • • THENCE North 29°01'00" East, et 1,225.44 feet pass a 1 inch iron pipe found on line for an angle point on the Southwest Naval Air Sta- tion Railroad right -cif -way, in all a distance of 1,300.44 feet to a 5/8 inch iron rod set for an'angle point .in said railroad right-of-way and the North corner of this survey; THENCE South •61°30'00" East, along said Southwest railroad right- of-way, parallel to the centerline thereof and 20.00 feet distant there- from, measured at right angles thereto, 231.51 feet for a corner of this survey; THENCE South 55°12'00" East, along the Southwest right-of-way line of said railroad, 353.50 feet for the beginning point of a curve to the •right'whose radius point bears South 34°13'00" West 724.31 feet and has a central angle of 84°43'00", a radius of 724_31 feet, a tangent dis- tance of 660.42 feet and an arc length of 1,070.95 feet; THENCE with said curve to the right, along the Westerly right-of-- way line of a 60 foot wide railroad spur to .Cabaniss Field, 1,070.95 feet for the point of tangency on said Northwest right-of-way line of Kostoryz Road; THENCE South 28°56'00" West, along the Northwest right-of-way line of Kostoryz Road, parallel to the original centerline (section .Zine) thereof and 80.00 feet distant therefrom, measured at right angles thereto, 535.00 feet to the POINT OF BEGINNING. TRACT B FIELDNOTES for 2.55 acres of land out of Lot 1, Section 8, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, !lap Records of Nueces County, Texas: BEGINNING at the point of intersection of the Southwest right- of-way line of the Naval Air Station 90.00 foot wide railroad right- of-way and the existing Northwest right-of-way line of Kostoryz Road for the East corner of this survey; THENCE South 28°56'00" West, along said Northwest right-of-way line of Kostoryz Road, parallel to the original centerline (section line) thereof and 30.00 feet distant therefrom, measured at right angles thereto, 640.54 feet for the point of intersection with the Easterly right-of-way line of a 60 foot wide railroad spur to Cabaniss Field for the South corner of this survey; THENCE with said Easterly right-of-way line, along a circular curve to the left whose radius point bears North 70°13'33" West 784.31 feet and having a central angle of 66°49'31", a radius of 784.31 feet, a tangent distance of 517.41, 914.76 feet to a point on said Southwest Naval Air Station Railroad right-of-way for the North corner of this .survey; THENCE South 61°30'00" East, along said Southwest right-of-way line of said railroad, parallel to the centerline thereof and 20.00 feet distant therefrom, measured at right angles thereto, 584.38 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and of r its passage, IT IS ACCORDINGLY SO ORDAINED, this the o27 day of 19 71 .
