HomeMy WebLinkAbout15102 ORD - 09/05/1979AN ORDINANCE AMENDING ORDINANCE N0. 8127, PROVIDING FOR ADMINISTRA- TION OF THE COMPENSATION PLAN FOR ALL POSITIONS IN THE CITY SERVICE, AS AMENDED, BY AMENDING SUBSECTION 501, AS AMENDED, BY SUBSTITUTING THE PUBLIC SAFETY SCHEDULE FOR POLICE AS REFLECTED IN EXHIBIT "A" ATTACHED HERETO, TO PROVIDE FOR AN 8.17% COST -OF -LIVING INCREASE EFFECTIVE JULY 30, 1979; ADOPTING A NEW SUBSECTION, 706, LONGEVITY PAY; AMENDING SECTION 950, LEAVES OF ABSENCE, BY AMENDING SUBSECTION 952.3, PROVIDING FOR PAYMENT OF ACCRUED SICK LEAVE, AS MORE FULLY SET FORTH HEREINAFTER; PROVIDING A SEVERANCE CLAUSE; PROVIDING AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 8127, providing for administration of the Compensation Plan for all positions in the City service, as amended, be amended by amending Subsection 501, as amended, by substituting the Public Safety Schedule for Police as reflected in Exhibit "A", attached hereto, to provide for an 8.17% cost -of -living increase effective July 30, 1979. SECTION 2. That there is hereby adopted a new subsection, 706, Longevity Pay, to read as follows: "706 Longevity pay for Police Officers shall be $6.00 per month for each complete year of service up to a maximum of ten years of service. Thereafter, for each additional year of service, longevity pay shall be $4.00 per month for each year up to a maximum of 25 years of service." SECTION 3. That Section 950, Leaves of Absence, is hereby amended by amending Subsection 952.3 to hereafter read as follows: "952.3 With the exception of Police Officers, payment of accrued sick leave not to exceed 90 working days shall be paid to employees or their beneficiaries upon termination due to TMRS retirment of any full-time employee, termination at age 62 or over upon completion of a minimum of 10 years continuous service with the City, disability retirement in accord- ance with TMRS or Social Security regulations, or death. Payment of such 15102 accrued sick leave shall be at the rate of the employee's last monthly salary or hourly rate for an equivalent period. Payment of accrued sick leave to Police Officers upon termination shall be based upon the following schedule: 1. Less than four full years of service: zero days. 2. Four full years of service: not more than 30 days. 3. Five full years of service: not more than 40 days. 4. Six full years of service: not more than 50 days. 5. Seven full years of service: not more than 60 days. 6. Eight full years of service: not more than.70 days. 7. Nine full years of service: not more than 80 days. 8. Ten full years of service: not more than 90 days. 9. Twenty -Five or more full years of service: not more than 180 days." SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, word, phrase or provision hereof be given full force and effect for its purpose. SECTION 5. Except as otherwise may be provided herein, the effective dates of the above changes shall be July 30, 1979. SECTION 6. The necessity to maintain at all times an efficient administration of City affairs creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its -2- introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the —5' day of September, 1979.
