AN ORDINANCE
AUTHORIZING EXECUTION OF A CONTRACT FOR A SIX-MONTH
TERM WITH THE CORPUS CHRISTI AREA WOMEN'S SHELTER,
INC. FOR $6,000 FOR THE PROVISION OF A SHELTER AND
COUNSELING SERVICES FOR BATTERED WOMEN, ALL AS MORE
FULLY SET FORTH IN THE CONTRACT, A SUBSTANTIAL COPY
OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF,
MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute a
contract for a six-month term with the Corpus Christi Area Women's Shelter,
Inc. for $6,000 for the provision of a shelter and counseling services for
battered women, all as more fully set forth in the contract, a substantial
copy of which is attached hereto and made a part hereof, marked Exhibit "A".
SECTION 2. The necessity to authorize execution of the afore-
said contract at the earliest practicable date creates a public emergency
and an imperative public necessity requiring the suspension of the Charter
rule that no ordinance or resolution shall be passed finally on the date of
its introduction but that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor having declared that such
emergency and necessity exist, and having requested the suspension of the
Charter rule and that this ordinance be passed finally on the date of its
introduction and take effect and be in full force and effect from and after
its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of September,
1979.

AGREEMENT
THE STATE OF TEXAS
COUNTY OF NUECES
This Agreement is entered into by and between the City of Corpus
Christi, hereinafter referred to as the "City"; and the Women's Shelter of
the Corpus Christi Area, Inc., hereinafter referred to as the "Shelter".
1. The Shelter agrees to provide the following services:
A. A temporary refuge for battered women and their children
residing in Nueces County from an abusive home situation.
B. Emotional support for battered women which will facili-
tate self-determination.
C.' Counseling to strengthen the family unit through evalua-
tion of stresses that provoke violence.
D. Community information concerning the social problems of
women battering and household violence.
2. In addition, the Shelter agrees to:
A. Provide all housing, food, support activities and staff
necessary to carry out a successful program designed to achieve the above
services.
B. Conform with and comply with all applicable local, state
and federal rules and regulations governing this type of program. Shelter
shall provide each client with a bill for services rendered based on fees
established by Shelter's Board of Directors.
C. Operate in a nonpartisan manner to serve women residents
of Nueces County without discrimination as to race, color, creed, national
origin or age.
D. Be responsible for the operation and maintenance of its
program, establish the number of persons it may serve, and operate the
program within available funds from whatever sources derived. Such
program operation and maintenance will be coordinated with the City -
County Health and Welfare Director.
E. Provide the City -County Health and Welfare Director with
monthly reports of'operating costs, income and number of clients served
indicating the financially needy versus the nonfinancially needy.
F. Allow the City's Director of Finance or his representa-
tive to inspect all books and records at any reasonable time.
G. Hold the City harmless from any and all liabilities which
may arise in connection with the operation of the Shelter and that
liability insurance covering the operations of said Shelter will be
obtained to the extent that the City might be liable under the Texas
Tort Claims Act.
H: Seek funding from sources other than the City and recog-
nize that the City's participation is temporary.
I. Provide that any acquired interest in personal or real
property will pass to the City and the County on an equal basis upon
dissolution of the Shelter, except those interests acquired by gift.
3. In consideration of the Shelter providing the above described
services for women of Nueces County, the City agrees to pay the total
sum of Six Thousand Dollars ($6,000) in support of the Women's Shelter
of the Corpus Christi Area, Inc. program at the rate of One Thousand
Dollars ($1,000) each month for a period of six (6) months beginning
August 1, 1979, subject to available budgeted funds.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
