DOT-FA76SW-1197 WITH THE UNITED STATES GOVERNMENT, DEPARTMENT OF TRANSPORTATION, FEDERAL AVIATION ADMINISTRATION, TO REDUCE THE RENTAL PAID ON UNFINISHED FLOOR SPACE ON THE THIRD FLOOR OF THE CONTROL TOWER ADDITION AT CORPUS CHRISTI INTERNATIONAL AIRPORT BY DELETING 1,263 SQUARE FEET OF UNFINISHED SPACE FROM THE LEASE; ALL AS MORE FULLY SET FORTH IN THE SUPPLEMENTAL AGREE- MENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A". BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. SUPPLEMENTAL AGREEMENT NO. 2 THIS SUPPLEMENTAL AGREEMENT, made and entered into this day of* ; 1979, by and between THE UNITED' STATES OF AMERICA, hereinafter called the Government, represented by.the Federal Aviation Administration, and the CITY OF CORPUS CHRISTI,"hereinafter called the Lessor, whose address is Route 2, P: 0. Box 902, Corpus Christi, Texas, '78408, WITNESSETH: WHEREAS, on the 1st day of September, -1975, tha•parties hereto entered into Lease No. DOT-FA76SW-1197, as amended in Supplemental Agreement No. 1, dated January 10, 1978, for the consideration and purposes more particularly stated in said lease, -as amended; and ' WHEREAS, the Government no longer has a requirement for 1,263 -square feet of unfinished space located on the second floor in the Tower Addition `• at International Airport, Corpus Christi, Texas, and desires to delete said space and the rentalr,therefor from the lease effective midnight May 31,1978; and - WHEREAS, the parties hereto find it is to their mutual benefit and *advantage to amend said lease, for the purposes of relinquishing the, aforesaid space and canceling the rental consideration thereof. - NOW, THEREFORE, effective midnight May 31, 1978, the said lease is hereby amended in the following -particulars only, viz; - . 1. Delete: 1,263 square feet of unfinished space from the lease, leaving 7 square feet of unfinished space; and - 2.` Reduce: The rental paid for said unfinished space in the amount of $2,222.88 to a new rental rate of $1,334:08 per annum payable by the Government monthly ata rate of $111.17, effective midnight May 31, 1978; and, • • 3. Change: Article 3 from $24,827.62 per annum to $22,604.74 per • annum payable monthly at the rate of $1,883.73; and, _ Lease No. DOT-FA76SW-1197 _ Supplemental Agreement,No. 2 AFS, Tall. Airport Corpus Christi, Texas 4. Change: Special Lease Provisions No. 9, Unfinished Space, from 2,021 square feet to read 758 square feet, and the total cost of unfinished space to read $1,334.08; and change the TOTALS to 3,700 square feet, and a -total rental of $22,604.74. 5. Change; ,-Article 10 from -$24,827.62 to $22, 604.74. . 6. Change: " Article. 11 from 2,021. square feet to -758 square feet.
