HomeMy WebLinkAbout15119 ORD - 09/19/1979AN ORDINANCE AMENDING THE CODE.OF ORDINANCES, CITY OF CORPUS CHRISTI 1976 REVISION, AS AMENDED, BY AMENDING SECTION 55-5, CITY TRANSIT SYSTEM --FARES, BY ADDING A NEW PARAGRAPH, (E), PERTAINING TO SPECIALIZED TRANSPORTATION SERVICES FOR THE ELDERLY AND HANDICAPPED; PROVIDING FOR SEVER- ABILITY; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. • WHEREAS, the City has been providing specialized transportation services to the senior citizens of the community through the Senior Community Services program for the past four years; and WHEREAS, the City Council has extended this service to the handi- capped population of the City; and WHEREAS, the City Council is desirous of establishing a fare for certain services; and WHEREAS, the City Council is desirous of exempting from any fare those senior citizens participating in the hot lunch program at Senior Community Centers; and WHEREAS, the City Council is desirous of exempting those handicapped persons who cannot utilize regular bus service without special assistance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Code of Ordinances, City of Corpus Christi, 1976 Revision, as amended, be amended by amending Section 55-5 by adding a new paragraph, (E), reading as follows: "(E) Specialized Transportation Services (1) For passengers age 65 years or older, upon presen- tation of a Medicare card or special identification card, the fare shall be 35 cents for all one way trips. If a person 65 years of age or older does not have a Medicare card, then a special identi- fication card will be issued to that person at no cost, upon appearing in person at either the Traffic and Transit office or the Transit SYstem office. (2) Senior citizens who are qualified, participate in, and are traveling to or from the hot lunch program at Senior Community Centers, Medicaid recipients the cost of whose transportation is paid by the Texas Department of Human Resources, and all handi- capped persons both elderly and non -elderly, shall • 15119 be exempt from the payment of any fare providing they can show evidence that they are participating in these program, or evidence that they are cer- tified as handicapped. Evidence may take the form of an identification card issued by Senior Community Services certifying that the bearer•is an eligible participant in the hot lunch program. Handicapped persons shall be issued a special iden- tification card, at no cost, by either the Traffic and Transit office or by the Transit System office, upon certification by a doctor or a community agency which serves the handicapped to the effect that the person is handicapped. For purposes of this ordin- ance, "handicapped person" shall be defined as an individual who, by reason of a permanent physical disability or incapacity, is unable to utilize re- gular mass transit services without special assis- tance." SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3. The fares established by this ordinance shall become effective October 1, 1979. SECTION 4. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance.
