AUTHORIZING THE CITY MANAGER TO EXECUTE DOCUMENTS NECESSARY
FOR THE ACQUISITION OF A PARCEL OF LAND FOR THE EVERHART
ROAD, PADRE ISLAND DRIVE TO STAPLES ADDITION OF ONE LANE,
PROJECT NUMBER 220-77-4; APPROPRIATING OUT OF THE 220 STREET
BOND FUND $10,582 OF WHICH $10,350 IS FOR ACQUISITION AND
$232 IS FOR INCIDENTAL EXPENSES RELATED TO CLOSING; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute documents
necessary for the acquisition of a parcel of land for the Everhart Road, Padre
Island Drive to Staples Addition of one lane, Project No. 220-77-4, from the
property owner, Exxon Corporation, said parcel being more particularly described
as follows:
Being an irregularly shaped tract of land out of Lot 4-A,
Block 3, Gray Village, as shown by map of record in 7olume
40, Page 185, Mao Records, Nueces County, Texas and more
particularly described by metes and bounds as follows:
Beginning at a point on the Northwesterly right -o_ -way line
of 80 foot wide Everhart Road, said point being the most
Easterly corner of abovementioned Lot 4-A, for the begin-
ing point of the tract of land herein described;
Thence S. 29° 09' 09"N., along the Northwesterly right-of-
way line of said Everhart Road, a distance of 158.95 feet to
a point being its intersection with the Northwest flare of
South Padre Island Drive right-of-way;
Thence S. 85° 55` 17" W., along the said Northwest flare of
South Padre Island Drive right-of-way, a distance of 12.14
feet to a point;
Thence N. 29° 09' 09" E., along a line that is 11.0 feet
Northwest of and parallel to the Northwesterly right-of-way
line of said Everhart Road, a distance of 84.10 feet to an
angle point;
Thence N. 36° 58' 54" E., a distance of 80.75 feet to the
place of beginning and containing 0.031 acres, more or less.
SECTION 2. That there is hereby appropriated the sum of $10,582
out of the No. 220 Street Bond Fund, of which amount $10,350 is for acquisi-
tion of the aforesaid parcel and4232 is foorC de J expenses related to
closing.

SECTION 3. The necessity to authorize execution of the aforesaid
documents and to appropriate sumsnecessary to acquire the above described
property at the earliest practicable date creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule that
no ordinance or resolution shall be passed finally on the date of its intro-
duction but that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mayor having declared such emergency
and necessity to exist, and having requested the suspension of the Charter
rule and that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from an after its passage,

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
