A RESOLUTION
APPROVING AN ALTERNATE PLAN FOR CHANGING THE NUMBER
OF DIRECTORS ON THE BOARD OF THE NUECES COUNTY TAX
APPRAISAL DISTRICT FROM FIVE TO SEVEN, CHANGING THE
METHOD OF SELECTING THE MEMBERS OF THE BOARD AND
CHANGING THE METHOD OF FILLING VACANCIES ON THE BOARD;
AND DECLARING AN EMERGENCY.
WHEREAS, Senate Bill 621, enacted by the Legislature of the
State of Texas, relating to ad valorem taxation of property, Subchapter A,
Section 6.01, provides for the establishment of tax appraisal districts
in each county; and
WHEREAS, Section 6.03, paragraphs (c) and (i) authorize the
governing bodies of three-fourths of the taxing units that are entitled
to vote on the appointment of members of a district's board of directors
to change the number of members of the board of directors or change the
method of selection of the members of the board; and
WHEREAS, the Nueces County Commissioners' Court alternate plan
proposing to change the number of the members of the board of directors,
changing the method of selection of the members of the board and the
filling of vacancies thereon as they occur is acceptable to the City of
Corpus Christi:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That approval is hereby given to the Nueces County
Commissioners' Court alternate plan, a copy of which is attached, for
changing the number of directors on the board of the Nueces County Tax
Appraisal District from five to seven and changing the method of selecting
the members of the board to electing such members by place with only the
taxing agency or agencies assigned that place being allowed to vote and
changing the method of filling vacancies on the board to be the same as
original selection with only the agency or agencies assigned that place
voting and allocating the Seven Place Board membership as follows:

SECTION 2. The necessity to indicate approval of a seven -member
governing board for the Nueces County Tax Appraisal District at the earliest
practicable date creates a public emergency and an imperative public neces-
sity requiring the suspension of the Charter rule that no ordinance or
resolution shall be passed finally on the date of its introduction but that
such ordinance or resolution shall be read at three several meetings of the
City Council, and the Mayor having declared that such emergency and necessity
exist, and having requested the suspension of the Charter rule and that this
resolution be passed on the date of its introduction and take effect and
be in full force and effect from and after its passage, IT IS ACCORDINGLY
SO RESOLVED, this the /9 day of September, 1979.

An Alternate Plan
An alternate plan outlined below would be put into the proper legal
form for consideration of each governing board. To make this, or any
other charge from the standard five -member board and allocation of •
votes, will require the affirmative resolution of at least fifteen
of the twenty participating members of the District.

C. Initial term of office is two years beginning September 1,
1979, although the Board does not officially- take or 'loe until
January 1, 1980. Also recommend changing the provision that if
a Sacancv occurs it shall be filled by the same method as the
original selection with only those agencies voting. For example
if in the middle of a tern - Place 5 should become vacant only
the county would vote on the selection of a successor for the
balance of the unexpired term.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
