HomeMy WebLinkAbout15134 ORD - 09/19/1979vmp:9/18,179:1st AN ORDINANCE CLOSING AND ABANDONING A 20 -FOOT ALLEY IN BLOCK 5, CALALLEN TOWNSITE, AS MORE FULLY DESCRIBED HEREINAFTER BY METES AND BOUNDS, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; PROVIDING FOR SEVER- ABILITY; AND DECLARING AN EMERGENCY. WHEREAS, a notice of the time and place for holding a hearing concerning the closing of a 20 -foot public alley situated in Block 5, Calallen Townsite, in the City of Corpus Christi, Nueces County, Texas, was given by publication and mail to the last known addresses of the owners of property abutting the alley proposed to be closed and within 450 feet of the area to be closed, and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting by the City Council of the City of Corpus Christi on September 12, 1979, in accordance with the provisions of the City Charter; and WHEREAS, it has been determined by the City Council after such hearing that a public alley, above described, proposed to be closed is not needed now, nor will it be, within the foreseeable future, needed as a public alley: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the public alley located in Block 5, Calallen Townsite, in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby closed for public use and abandoned to the abutting property owners, said alley being more fully described by metes and bounds as follows: FIELDNOTE DESCRIPTION of a 0.130 acre, more or less, tract of land being all of the 20.00 foot alley adjacent to Lot 1-A and Lot 2-A, Block 5, Calallen Townsite, ac- cording to the replat recorded in Volume 29, Page 79, Map Records, Nueces County, Texas, and also adjacent to Lots 3 through 8, inclusive, Block 5, Calallen, as shown by plat recorded in Volume 1, Page 44, Map Records, Nueces County, Texas, said tract being more particularly described as follows: BEGINNING at the southwest corner of said Lot 3, Block 5, said point being on the northerly right-of-way line of a 60.00 foot public roadway known as Third Street, for the southeast corner and POINT OF BEGINNING of this tract; THENCE, S 70° 46' 00" W, along said northerly right-of-way line 20.00 feet to the south- east corner of said Lot 1-A, Block 5, for the southwest corner of this tract; THENCE, N 19° 14' 00" W, along the easterly boundary line of said Lots 1-A and 2-A, Block 5, at 60.00 feet pass the common northeast corner of said Lot 1-A and the south- east corner of said Lot 2-A, in all a distance of 266.77 feet to a point on the easterly right-of-way line of a 50.00 foot public roadway known as Calallen Drive, said point being the north corner of said Lot 2-A, for the northwest corner of this tract; 15131: pVG Vatlottu THENCE, N 11° 48' 32" E, 38.78 feet to the northwest corner of said Lot 8, Block 5, said point being on the southerly right-of-way line of a 60.00 foot public roadway known as Fourth Street, for the northeast corner Of this tract; THENCE, S 19° 14' 00" E, along the westerly boundary lines of said Lots 3 through 8, at 50.00 feet pass the common southwest corner of said Lot 8 and the northwest corner of said Lot 7, at 100.00 feet pass the common southwest corner of said Lot 7 and the north- west corner of said Lot 6, at 150.00 feet pass the common southwest corner of sail Lot 6 and the northwest corner of said Lot 5, at 200.00 feet pass the common southwest corner of said Lot 5 and the northwest corner of said Lot 4, at 250.00 feet pass the common southwest corner of said Lot 4 and the northwest corner of said Lot 3, in all a distance of 300.00 feet to the POINT OF BEGINNING. SECTION 2. The fact that the public convenience and necessity would be better served by the closing of the hereinabove described alley creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /4 & day of September, 1979.
