HomeMy WebLinkAbout15152 ORD - 09/26/1979VP:9/26/79:1st AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE N0. 6106, AS AMENDED, UPON APPLICATION OF HIGHWAY PIPELINE TRUCKING BY AMENDING THE ZONING MAP BY CHANGING THE ,ONING OP A 5.046- ACRE TRACT OF LAND OUT OF LOT 1, BLOCK PARIIIIUN Oh IAt J.L. RUSSELL FARM BLLTOCKSSpUE , TEXAS, FROM "IE2" LIGHT INDUSTRIALIDISTRIICTCES COUNTY, TO "I-3" HEAVY INDUSTRIAL DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recormendations concerning the application of Highway Pipeline Trucking for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on September 26, 1979 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 15152 MICROFILMED «G 2 81980 I SECTION 2. That the following described tract or parcel, being a 5.046* acre tract of land out of Lot 1, Block 7, Partition of the J. C. Russell Farm Blocks, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby changed from "I-2" Light Industrial District to "I-3" Heavy Industrial District, said property being more particularly described as follows: FIELDNOTE DESCRIPTION of a 5.046 acre, more or less, tract of land to be known in part as Lot 12, Block 6, Roblex Industrial Area, said tract being composed of a portion of Block 11, J. C. Russell Farm Blocks as shown by plat recorded in Volume 3, Page 53, Map Records, Nueces County, Texas, and a portion of Lot 1, Block 7, Partition of a portion of J. C. Russell Farm Blocks as shown by plat recorded in Volume 28, Pages 58 and 59, Map Records, Nueces County, Texas, said tract being more particularly described as follows: COMMENCING at the southwest corner of said Block 11, J. C. Russell Farm Blocks, said point being the southwest corner of said Lot 1, Block 7, Partition of a portion of J. C. Russell Farm Blocks and also being on the east right-of-way line of a 40.00 foot public roadway known as Flato Road and also on the north right-of-way line of an unimproved 40.00 foot public roadway; THENCE, NORTH, along said east right-of-way line and the west boundary line of said Block 11 and the west boundary line of said Lot 1, Block 7, a distance of 1,566.76 feet to a point for the southwest corner and POINT OF BEGINNING of this tract; THENCE, continuing NORTH, along said east right-of-way line and along said west boundary lines 167.75 feet to a point for the northwest corner of this tract, said point being WEST 12.00 feet and SOUTH 1,677.50 feet from the southwest corner of Lot 1, Block 6, Roblex Industrial Area, as shown by plat recorded in Volume 44, Page 30, Map Records, Nueces County, Texas; THENCE, EAST, parallel to and 844.09 feet from the north boundary line of said Block 11 and the north boundary line of said Lot 1, Block 7, a distance of 1,310.36 feet to a point on the common east boundary line of said Block 11, the east boundary line of said Lot 1, Block 7, and the west boundary line of Lot 3, Block 7, said Partition of a portion of J. C. Russell Farm Blocks, said point being the northeast corner of this tract; THENCE, SOUTH, along said common boundary lines 167.75 feet to a point for the south- east corner of this tract; THENCE, WEST, 1,310.36 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from andfter its passage, IT IS ACCORDINGLY SO ORDAINED, this the 2 ` day of J .Gtl'/ 19?/ .
