HomeMy WebLinkAbout15154 ORD - 10/03/1979jkh:9-28-79;1st • AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CHANGE ORDER TO THE CONTRACT WITH PERMIAN CONSTRUCTION COMPANY AND REPUBLIC MECHANICAL CORPORATION, A JOINT VENTURE, FOR IMPROVEMENTS TO AND EXPANSION OF THE OSO WASTEWATER TREATMENT PLANT, PROVIDING FOR A DESIGN CHANGE OF CERTAIN FOUNDATION PIERS; APPROPRIATING $13,450 FOR THE CHANGE ORDER OUT OF THE N0. 250 SANITARY SEWER BOND FUND APPLICABLE TO PROJECT N0. 250-77-4, OSO PLANT IMPROVEMENTS, BOTH THE APPROVAL OF THE CHANGE ORDER AND THE APPROPRIATION OF FUNDS BEING SUBJECT TO THE CONCURRENCE IN AND APPROVAL OF THE ENVIRON- MENTAL PROTECTION AGENCY (C-48-1214-03); AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute a Change Order to the contract with Permian Construction Company and Republic Mechanical Corporation, a joint venture, for improvements to and expansion of the Oso Wastewater Treatment Plant, providing for a design change of certain foundation piers, as more particularly described in the Change Order, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated the sum of $13,450 out of the No. 250 Sanitary Sewer Bond Fund for the aforesaid Change Order applicable to Project No. 250-77-4, Oso Plant Improvements. Both the approval of the aforesaid Change Order and the appropriation herein and hereby provided are subject to the concurrence in and approval of the Environmental Protection Agency (C-48-1214-03). SECTION 3. The necessity to authorize execution of the said Change Order and appropriation of the sums described, subject to approval of and concurrence by the Environmental Protection Agency, creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolu- tion shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be 15154 MICRuilL1V1to AUG 281980 passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of October, 1979. If necessary, change 14 inch diameter shafts with 42 inch diameter underreamed piers at a bottom elevation of -2.1 feet to 18 inch diameter straight shafts (no underreamed piers) with a bottom ele- vation of -11.0 feet. b.
