HomeMy WebLinkAbout15159 ORD - 10/03/1979JBA:vp:10/3/79:1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN ENDORSEMENT OF THE AMENDMENT TO THE WATER PURCHASE CONTRACT DATED ti SEPTEMBER 12, 1978 BETWEEN THE SAN PATRICIO WATER DISTRICT AND THE SEABOARD WATER SUPPLY CORPORATION, A SUBSTANTIAL COPY OF WHICH AMENDMENT IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED "EXHIBIT A", ADDING THE STIPULATION THAT NOTHING IN PARAGRAPH C 11 OF THE CON- TRACT BETWEEN THE CITY OF CORPUS CHRISTI AND THE SAN PATRICIO MUNICIPAL WATER DISTRICT DATED MAY 27, 1963 IS INTENDED TO ELIMINATE THE OBLIGATION OF SAN PATRICIO MUNICIPAL WATER DISTRICT TO FURNISH WATER TO SEABOARD WATER SUPPLY CORPORATION FOR THE TERM OF THE 1978 CONTRACT; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, - TEXAS: SECTION 1. That the City Manager is hereby authorized to execute an endorsement of the amendment to the Water Purchase Contract dated September 12, 1978 between San Patricio Municipal Water District and the Seaboard Water Supply Corporation, a substantial copy of which amendment is attached hereto and made a part hereof, marked "Exhibit A", adding the stipulation that nothing in paragraph C 11 of the contract between the City of Corpus Christi and the ' San Patricio Municipal Water District dated May 27, 1963 is intended to eliminate the obligation of San Patricio Municipal Water District to furnish water to Seaboard Water Supply Corporation for the term of the 1978 contract:. SECTION 2. The necessity to authorize execution of the aforesaid amended contract at the earliest practicable date creates a public emergency . and an imperative public necessity requiring the suspension of the Charter ' rule that no ordinance or resolution shall be passed finally on the date of -its introduction but that such ordinance or resolution shall be read at three .several meetings of the City Council, and the Mayor having declared such emergency and necessity exist, and having requested the suspension of the - Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 3 day of October,•1979. AUG 2 81980 10/3/79 AMENDMENT TO THE WATER PURCHASE CONTRACT This is an amendment to that one certain Water Purchase Contract dated September 12, 1978 between the San Patricio Municipal Water District, hereinafter referred to as "Seller" and the Seaboard Water Supply Corporation, hereinafter referred to as "Purchaser". WITNESSETH: WHEREAS, the Seller and Purchaser entered into a Water Purchase Contract dated September 12, 1978 and desire to amend paragraph C 11 of said contract; NOW, THEREFORE, paragraph C 11 shall be amended as follows: C. It is mutually agreed between the Seller and the Purchaser as follows: 11. That the Purchaser shall comply with the terms and provisions of the Water Purchase Contract between the City of Corpus Christi and the San Patricio Municipal Water District dated May 27, 1963. Nothing in this paragraph is intended to eliminate the obligation of San Patricio Munici- pal Water District to furnish water to Seaboard Water Supply Corporation for the term of this contract. IN WITNESS WHEREOF, the parties hereto, acting under the authority of their respective governing bodies, have caused this contract to be amended. MARVIN TOWNSEND, CITY MANAGER �, Q Corpus Christi, Texas ©t 3 day of , 1917 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
