HomeMy WebLinkAbout15172 ORD - 10/17/1979AN ORDINANCE AN ORDINANCE FINDING THAT THE CREATION OF A HOSPITAL AUTHORITY IS IN THE PUBLIC INTEREST, CREATING A HOSPITAL AUTHORITY UNDER AND BY VIRTUE OF THE POWERS CONFERRED UPON SAID CITY BY THE HOSPITAL AUTHORITY ACT; DESIGNA- TING THE NAME BY WHICH SAID AUTHORITY SHALL BE KNOWN; APPOINTING THE FIRST BOARD OF DIRECTORS; PROVIDING FOR SEVERABILITY; PROVIDING FOR PUBLICATION; AND ORDAINING SUNDRY PROVISIONS INCIDENT AND RELATED TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE, ALL AS MORE FULLY SET FORTH HEREIN. WHEREAS, under the provisions of the Hospital Authority Act (Chapter 472, Acts of the 55th Legislature, Regular Session 1957, codified as Vernon's Ann. Civ. St. art. 4437e), the City Council of the City of Corpus Christi (hereinafter referred to as the "City") is authorized and empowered to create a Hospital Authority if the creation thereof is found to be in the public interest of the City and its inhabitants; and WHEREAS, the City Council has caused an investigation to be made and now finds that it is in the public interest of the City and its inhabi- tants to create a Hospital Authority under the provisions of the aforesaid Act. 1:A. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: Section 1. That the City Council hereby finds that is is in the public interest of the City and its inhabitants to create a Hospital Authority. Section 2. That by virtue of the power conferred upon the City by the Hospital Authority Act, a Hospital Authority comprising the territory included within the boundaries of the City is hereby created and shall be known as the Coastal Bend Hospital Authority (hereinafter called the "Authority").. Section 3. That the Authority shall be governed by the Board of Directors consisting of seven (7) members; that the Gollowing will be appointed first Directors of said Authority on third reading hereof and this ordinance will then be completed by the insertion of their names as follows: 15172 MICRO ��;g0 SVG 4 ' Don Hanks Gabe Lozano, Sr. Frank Wiggins Jack Solka Max J. Luther, III Pedro P. Garcia Wm. H. Keys and that each of said Directors shall, unless other provision is made in the bond resolution or trust indenture in connection with the issuance of bonds as provided in the Hospital Authority Act, serve for a term of two years from the date hereof and until their successors have been appointed by the City Council of the City and have duly qualified. Section 4. That it is hereby officially found and determined that the meeting at which this Ordinance is passed was open to the public as re- quired by law and public notice of the time, place and purpose of said meeting was given as required by Vernon's Ann. Civ. St. art. 6252-17, as amended. Section 5. This ordinance shall take effect and be in full force and effect from the date of its adoption on third reading. Section 6. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. Section 7. Civ. St. art. 4437e), be amended as follows prior to the third and final reading: A. In Section 2 of said ordinance, identify the Hospital Authority as the "Coastal Bend Hospital Authority." B. In Section 3, indicate that the Board of Directors shall consist of seven members, and that the following be appointed first Directors of said Authority: Don Hanks Gabe Lozano, Sr. Frank Wiggins Jack Solka Max J.
