NOTIFYING ATHENA CABLEVISION OF CORPUS CHRISTI THAT
ITS FRANCHISE WILL EXPIRE ON NOVEMBER 17, 1979;
GRANTING PERMISSION FOR THAT COMPANY TO OPERATE AFTER
NOVEMBER 17, 1979 ON A WEEK TO WEEK BASIS; RESERVING
ALL RIGHTS OF THE CITY; AND DECLARING AN EMERGENCY.
WHEREAS, the term of the franchise granted to Athena Cablevision
of Corpus Christi, Inc. (hereinafter referred to as "Athena") to operate
a community antenna television system (cable television) within the City
of Corpus Christi will expire on November 17, 1979; and
WHEREAS, it is desirable that cable television service to the
citizens of Corpus Christi be not interrupted; and
WHEREAS, the City Council should consider all competing applica-
tions for acabletelevision franchise:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. Notice is hereby given to Athena Cablevision of Corpus
Christi, Inc. that on November 17, 1979, the term of its franchise, and hence,
its right to operate a community antenna television system within the City of
Corpus Christi, will expire except as extended by Section 2 hereof.
SECTION 2. After November 17, 1979, pending review of applications
for a franchise to operate a CATV system, Athena will be allowed to continue
operating its system on the same conditions as provided in the expired fran-
chise ordinance (No. 12268) and rate ordinance (No. 13193), on a week -to -
week basis at the pleasure of the City Council, but not to extend for more than
six months from November 17, 1979.

SECTION 3: By allowing Athena to continue operating beyond the term
of its franchise, as provided in'Section 2 hereof, the City of Corpus Christi
does not waive any rights it would otherwise have, 'including but not limited to,
the right to deny Athena's application for renewal of its franchise, to pro-
hibit Athena from operating without a franchise, or to acquire all or a portion
of Athena's system.
SECTION 4: The necessity to notify Athena Cablevision of this action
at the earliest possible date creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no ordinance or

resolution shall be passed finally on the date of its introduction but
that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared that such emergency and
necessity exist, having requested that the Charter rule be suspended and
that this ordinance be passed finally on the date of its introduction and
take effect and be in full force and effect from and after its passage, IT
IS ACCORDINGLY SO ORDAINED, this the

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
