AN ORDINANCE
FINDING THAT SUFFICIENT TIME IS NOT AVAILABLE FOR THE
CITY,OF CORPUS CHRISTI TO COMPLETE NECESSARY ANALYSIS
OF THE RATE INCREASE REQUEST BY CENTRAL POWER AND LIGHT
COMPANY; SUSPENDING THE REQUESTED_RATE INCREASE FOR A
PERIOD NOT TO EXCEED 120 DAYS BEYOND OCTOBER:1, 1979;
AUTHORIZING THE CITY OF CORPUS CHRISTI TO JOIN OTHER
CITIES flF THE CENTRAL POWER AND LIGHT SYSTEM IN A
COOPERATIVE EFFORT TO DETERMINE A FAIR AND REASONABLE
RATE FOR SAID UTILITY; APPROPRIATING AND REAPPROPRIATING
OUT OF THE 102 GENERAL FUND THE SUM OF $30,678.75 AS THE
CITY,'S' CONTRIBUTION TO A COMMON FUND PRO -RATA ACCORDING
TO POPULATION BASED ON THE 1970 FEDERAL CENSUS; AUTHORIZING
THE CITY MANAGER TO ACT FOR AND ON BEHALF OF THE CITY OF
CORPUS CHRISTI',IN THE SELECTION OF AN EXECUTIVE COMMITTEE
TO DIRECT THE COMMON EFFORT, EMPLOY EXPERTS AND ARRANGE FOR
AND DIRECT PAYMENT OF EXPENSES INCURRED IN THIS COMMON
PROJECT; AND DECLARING AN EMERGENCY.
WHEREAS, the Public Utility Regulatory Act, Article 1446 et seq.
V'.A.T.S., provides for a definite procedure which must be followed by a Public
Utility in order to implement a revised schedule of rates; and
WHEREAS, Central Power and Light Company has,presented to the City of
Corpus Christi a revised schedule of tariffs and a request that said company be
placed on the agenda for action by the City Council at3the earliest possible
time; and .,.
WHEREAS, Central Power and Light Company has presented to the, Public
Utility Commission a revised schedule of tariffs outside municipal boundaries
which tariffs will affect system -wide revenues; and
_ WHEREAS, the City of Corpus Christi is currently seeking the service of
a qualified rate expert for the purpose of evaluating the revised rate schedule
as submitted by Central Power and Light Company; and
WHEREAS, additional time is needed to allow the consultants adequate
time for study in preparation of testimony for the hearing concerning the re-
quested rate increase; and
WHEREAS, the City of Corpus Christi has joined other cities in the
Central Power and Light Company system in a cooperative effort to analyze the
material submitted by Central Power and Light Company; and
WHEREAS, an Executive Committee has been named consisting of Walter Hill,
Jr., City Manager, Sinton; Roberto Gonzalez, City Manager, Eagle Pass; and Jim
Darling, City Attorney, McAllen; and

WHEREAS, it is the opinion of the City Council of the City of Corpus
Christi that it is' in the interest of this city and its electric energy users
of the City that the City join other cities of the Central Power and Light system
in South Texas in this cooperative effort:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI that:
SECTION 1. The City of Corpus Christi is of the conviction that the
regulatory role provided by the law for said city is of extreme importance and
must be completely fulfilled.
SECTION 2. Sufficient time is not available prior to November 5,
1979 for the City of Corpus Christi to complete the necessary analysis of the
revised rate schedule. That for the reasons stated above which have heretofore
been delivered in writing to Central Power and Light Company, the revised rate
schedule filed by Central Power and Light Company scheduled to become effective
November 5, 1979 is hereby suspended in accordance with Section 43(d) of the Public
Utility Regulatory Act, and may not be placed in operation within the area of
jurisdiction of the City of Corpus Christi for a period of time not to exceed 120
days beyond November 5, 1979.
SECTION 3. That there is hereby appropriated and reappropriated
out of the No. 102 General Fund the sum of $30,678.75 as the City's contribu-
tion to a common fund pro -rata according to the population based on the 1970
Federal Census. From said fund, there is hereby authorized a contribution
of fifteen cents ($,15) per inhabitant of this city according to the 1970
federal census,
SECTION 4. The City Manager be and is hereby designated to act for
this city in the selection of an Executive Committee to direct the common cause,
employ -experts, and arrange for payment of expenses incurred in this common
project. -
SECTION 5. Selection by the Executive Committee of the following
consultants and attorneys:
Touche-Ross and Company
Dallas, Texas
McGinnis, Lochridge and Kilgore
Austin, Texas
as its consultants and attorneys is hereby ratified and approved and said con-
sultants and attorneys are authorized to speak for and represent the City of
Corpus Christi in all activities and actions pertaining to the Central Power and
Light Company rate request, to request and receive such information as is

necessary in its investigation from Central Power and Light Company, and others,
and to represent the City in all matters pertaining to the rate request before
the cities, the Public Utility Commission and the courts.
SECTION 6. Legal counsel be authorized to intervene and/or ratify
intervention before the Public Utility Commission on the request by Central
Power and Light Company to increase rates outside municipal boundaries docketed
as Public Utility Commission Order No. 2840 on behalf of all of the cooperating
cities.
SECTION 7. The City Secretary be hereby ordered to deliver a certified
copy of this ordinance to Central Power and Light Company and to the Chairman of
the Executive Committee of the cooperating cities.
SECTION 8. The urgent necessity for theCity of Corpus Christi to join
other cities in this cooperative effort creates a public emergency and an impera-
tive public necessity requiring the suspension of the Charter rule that no
ordinance or resolution shall be passed finally on the date of its introduction
but that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared such emergency and necessity
to exist, having requested the suspension of the Charter rule and that this
ordinance take effect and be in full force and effect om and`.a-fteer its passage,

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
