AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT
WITHTHE ART COMMUNITY CENTER FOR SUPPORT OF THE CENTER,
AS MORE FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL
COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF,
MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be, and he is hereby authorized
and directed, for and on behalf of the City of Corpus+Christi, to enter into'
an agreement with the Art Community Center for support of the Center, as more
fully set forth in the agreement, a substantial copy'of which is attached
hereto, made a part hereof, and marked Exhibit "A".
SECTION 2. The necessity to authorize execution of the aforesaid
agreement at the earliest practicable date creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule that
no ordinance or resolution shall be passed finally on the date of its intro-
duction but that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mayor having declared that such emer-
gency and necessity exist, having requested the suspension of the Charter
rule and that this ordinance be passed finally on'the date of its introduc-
tion and take*effect and be in full force and effect from and after its pas-
sage, IT IS ACCORDINGLY SO ORDAINED, this the 21 day of October, 1979.

AGREEMENT
THE STATE OF TEXAS i
COUNTY OF NUECES f
WHEREAS, the City of Corpus Christi, hereinafter referred to as
"City" owns and has leased to the Art Community Center, hereinafter referred
to as "Center", the buildings and fixtures at 902 Park Avenue in South Bluff
Park for a period of five years ending December 6, 1981; and
WHEREAS, City under the terms of the abovementioned lease provides
cleaning and restroom supplies, maintenance of the exterior of the building
and grounds, paints the interior of the building as needed, pays all utility
bills except telephone service, and includes the buildings in its fire and
extended coverage and liability insurance policies; and
WHEREAS, Center, a nonprofit organization, provides opportunities
for all citizens of Corpus Christi to broaden their appreciation of the arts;
NOW, THEREFORE, in consideration of the covenants and agreements
contained herein, the parties hereto do hereby agree to the following:
1. Center agrees to keep the Center open six days per week
consistent with the City's leisure services programs; to levy no admission
charges on the general public attending events presented by Center; that mem-
bership in Center will be open to all citizens who have an active interest
in art; and to provide art shows, workshops, lectures, art classes and facili-
ties for winter tourists to paint while visiting Corpus Christi.
2. City agrees to pay Center for the 1979-80 fiscal year a sum
not to exceed $2,500.00 for postage, office supplies, printing and telephone
expenses, incurred by Center. Payment will be by reimbursement on receipt of
paid statements covering these expenses.

For the reasons set forth in -the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
