HomeMy WebLinkAbout15188 ORD - 10/24/1979nh:10-22-79:1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE DOCUMENTS NECESSARY FOR THE ACQUISITION OF PARCELS 16 THROUGH 21 IN CONNECTION WITH THE GABRIEL TERRACE DRAINAGE OUTFALL, PROJECT NUMBER 295-72-2; APPROPRIATING OUT OF THE NO. 295 STORM SEWER BOND FUND $100,000 OF WHICH $87,259 IS FOR ACQUISITION AND $12, 741 IS FOR CONTINGENCIES AND INCIDENTAL EXPENSES RELATING TO CLOSING; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute documents necessary for the acquisition of Parcels 16 through 21 in connection with the Gabriel Terrace Drainage Outfall, Project No. 295-72-2, the parcels and the owners Of said parcels being generally described as follows: Parcel 16 Parcel 17 Owners Patricia Ray Peterson Nuss, et al Portion of Tract 2-B, M.M. Gabriel Partition of the Gugenheim & Cohn's Farm Lots. Henry Nuss, et al Portion of Tracts 3-B & 4, M.M. Gabriel Partition of the Gugenheim & Cohn's Farm Lots. Parcel 18A Peterson Properties, Inc. Parcel 18B -Peterson Properties, Inc. Portions of Lots 13,'14, Womack Farm Lots. Parcel 19 United States of America Portion of Lot 13, W. 0. Womack Farm Lots. Parcel 20 James F. Kucera, Jr., & wife Portion of Lots 11, 12, 13, W. 0. Womack Farm Lots. Parcel 21 Peterson Properties, Inc. Portion of W. J. Robertson Tract, Rincon Del Oso Grant, Abstract No. 1 SECTION 2. That there is hereby appropriated the sum of $100,000 out of the No. 295 Storm Sewer Bond Fund, of which amount $87,259 is for acquisition of the aforesaid parcels and $12,741 is for contingencies and inci- dental expenses relating to closing. SECTION 3. The necessity to authorize execution of the documents aforesaid and to provide the sums necessary to acquire the said parcels for the Gabriel Terrace Drainage Outfall at the earliest practicable date in order that the project may proceed without delay creates a public emergency and an MICROFILMED, /Ails 2 8 1980 15188 imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the ..2,/ day,of October, 1979.
