HomeMy WebLinkAbout15200 ORD - 10/24/1979jkh:10-24-79;lst AN ORDINANCE - AMENDING THE ZONING ORDINANCE OF THE CITY -OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106 AS AMENDED; UPON APPLICATION OF HOWELL CORPORATION BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON 23.6 ACRES OUT OF THE PETER J. WHELAN 42.4 ACRE TRACT OUT OF THE JOHN DUNN 100 -ACRE TRACT OUT OF THE ENRIQUE VILLAREAL GRANT, ABSTRACT NO. 1, NUECE$ COUNTY, TEXAS, MORE PARTICULARLY DESCRIBED HEREINAFTER, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "I-2" LIGHT INDUSTRIAL DISTRICT TO"I-3" HEAVY INDUSTRIAL DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Howell Corporation for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held'at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on October 24, 1979 • , at Regular Wednesday Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and. WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. ;a M1CRo � ��,1,��Q, SECTION 2. That the zoning of the following described tract or parcel be and the same is hereby changed from "I-2" Light Industrial District to "I-3" Heavy Industrial District: Being a tract or parcel consisting of 23.6 acres out of the Peter J. Whelan 42.4 acre tract out of the John Dunn 100 acre tract out of the Enrique Villareal Grant, Abstract No. 1, Nueces County, Texas: Beginning at a 1" iron pipe found in the South boundary of Up River Road at the Northwest corner of said Peter J. Whelan Tract which also is the Northeast corner of Ehlers Gardens Tracts, an unrecorded subdivision of 40 acres out of said John Dunn 100 acre tract, for the Northwest corner of this survey; Thence South 78° 22' 50" East, with said South boundary 103.68 feet to its intersection with the West boundary • of a 16.086 acre tract conveyed to the City of Corpus Christi by J. R. Heldenfels, Trustee, as described in Volume 885, page 145 of the Deed Records of Nueces County, Texas, for the Northeast corner of this tract; Thence South 6° 58' 10" East, 1,475.96 feet for an inside corner of this survey; Thence North 83° 01' 50" East 5.0 feet to a point for a corner of this survey; Thence South 6° 58' 10" East, 522.84 feet to the North right-of-way line of I.H. 37 for the Southeast corner of this survey, from which corner a concrete highway right-of-way marker bears South 84° 35' 32" East 26.19 feet; Thence North 84° 35' 32" West, with the North right-of- way line of I.H. 37, 238.28 feet to the point of curva- ture of a curve to the left which has a central angle of 8° 32' 23", and a radius of 4,733.75 feet; Thence along said curve in a Westerly direction 705.55 feet to a concrete highway right-of-way marker found for the point of tangency; Thence South 86° 52' 05" West continuing with the North right-of-way of I.H. 37, 28.09 feet to the boundary between the above mentioned 42.4 acre tract and Ehlers Gardens Tracts, for the Southwest corner of this survey; Thence North 17° 30' East with said boundary between the 42.4 acre tract and Ehlers Gardens 2,064.96 feet to the place of beginning containing 23.60 acres of land. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. Corpus Christi, Texas 2 day 0004 /4„, 1977 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
