BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION; AND ORDAINING OTHER MATTERS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY. WHEREAS, it is hereby officially found and determined: that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this Ordinance is passed, such emergency or urgent public neces- sity being that,the publication of Notice of Intention to Issue Certificates of Obligation to provide proceeds for the construction of necessary and urgently needed public improvements is required as soon as possible and without delay; and that said meeting was open to the public, and public notice of the time, place and purpose of said meeting was given, all as"required by Vernon's Ann. Civ. St. art. 6252-17, as amended. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: Section 1. That attached hereto and marked "Exhibit A" is a form of notice, the form and substance of which are hereby passed and approved. Section 2. That the City Manager shall cause said notice to be published, .in substantially the form attached hereto, in the Corpus Christi Caller (Times) , a newspaper of general circulation in the City of Corpus Christi, Texas, for two consecutive weeks, the date of the first publication to be November 2 , 1979, which date is at least fourteen (14) days prior tb the day tentatively proposed for authorizing the issuance of the Certificates of Obligation as shown in said notice. Section 3. The fact that the contemplated construc- tion of public improvements is necessary for the orderly development and growth of the City of Corpus Christi; Texas;=;creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule pro- viding that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordi- nance or resolution shall be read at three several meetings of the City Council and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that said Charter Rule be suspended and that this ordinance take effect and be in full force and effect from and after its passage, it is accordingly so ordained. Section 4. That all ordinances and resolutions or.' parts thereof.in conflict herewith are hereby. repealed;. PASSED AND APPROVED this the s% day of �, 1979. The City Council tentatively proposes to authorize the, issuance of said Certificates of Obligation at its regular meeting place in the City Hall at a regular meeting to commence at 11:00 o'clock, A. M., on the 21st day of November, 1979. The maximum amount of Certificates of Obligation indebted- ness that may be authorized for such purpose is $5,950,000. The City Council presently prdposes to provide for payment of such Certificates of Obligation by the levy of taxes and from certain revenues derived from the hotel occupancy tax collected by the City and the parking facilities of the City at the City's airport and at the community - convention facility.
