AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT BETWEEN
THE CITY OF CORPUS CHRISTI, TEXAS AND CORONA ASSOCIATES,
WHICH PROVIDES FOR PAYMENT TO THE CITY OF $2939.09, SUCH
AMOUNT BEING THOSE COSTS OVER AND ABOVE AN AMOUNT NORMALLY
ALLOWED THE CITY BY VIRTUE OF THE ELECTRIC SERVICE RATE
SCHEDULE OF MAY 23, 1977, FOR THE INSTALLATION OF SIX
4000 LUMEN MERCURY VAPOR LIGHTS ON THREE ORNAMENTAL
STANDARDS ON CORONA DRIVE JUST WEST OF EVERHART; AND DECLAR-
ING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute a
contract between the City of Corpus Christi, Texas and Corona Associates,
which provides for payment to the City of $2939.09, such amount being those
costs over and above an amount normally allowed the City by virtue of the
electric service rate schedule„of May 23, 1977, for the installation of six -
4000 lumen mercury vapor lights on three ornamental standards on Corona
Drive just west of Everhart, a substantial copy of which contract is attached
hereto and made a part hereof, marked Exhibit A.
SECTION 2. The necessity to authorize the aforesaid contract at
the earliest practicable date creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule that no ordi-
nance or resolution shall be passed finally on the date of its introduction
but that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared that such emergency and
necessity exist, having requested the suspension of the Charter rule and
that this ordinance be passed finally on the date of its introduction and
take effect and be in full force and effect from and after its passage, IT

CONTRACT
THE STATE OF TEXAS
COUNTY OF NUECES
WHEREAS, the City of Corpus Christi, hereinafter referred to as
"City" and Corona Associates, a Texas partnership, hereinafter referred to
as "Company", desire to enter into an agreement providing for the installa-
tion of decorative street lighting fixtures in lieu of standard lighting
equipment; and
WHEREAS, it is the desire of Company that such lighting fixtures
be placed in the public right-of-way adjacent to certain real property in
which Company owns an interest for the purpose of enhancing the aesthetic
appearance of same; and
WHEREAS, the City and Company have reached an agreement as to
payment by Company to City of the cost of installation of said lighting
fixtures in excess of the cost of standard lighting equipment:
NOW, THEREFORE, this agreement, made and entered into by and between
the City and Company for and in consideration of the exchange of mutual
covenants and conditions herein contained, to be kept and performed by the
parties hereto, the City and Company do hereby covenant and agree as follows:
1. That the City shall install or cause to be installed in the
median of Corona Drive between a point approximately 300 feet northwesterly
of the intersection of Corona Drive and Everhart Road and the Corona -Everhart
intersection, three (3) twenty -foot aluminum standards on each of which will
be mounted two (2) 4,000 lumen mercury vapor lights. The location and con-
struction of said luminaires shall be done in accordance with the map and '
plan marked Exhibit "A" and "B" respectively, attached hereto and made a
part hereof.
2. That upon execution of this instrument and acceptance of same
by the City, Company shall pay the City the sum of $2,939.09, which amount
represents the additional cost over and above the normal deduction allowed
by the City for the installation of standard lighting fixtures. In the
event that the cost of such project at time of completion is less than the
contract price, the amount of overpayment shall be refunded to Company.

TO THE MEMBERS OF THE CITY COUNCIL

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
