THENCE North 26°06'20" East, for a distance of 4.0' to a point for corner; THENCE South 63°53'40" East, for a distance of 3.5' to the PLACE OF BEGINNING, containing 14.0 square feet of land. Said closing and abandonment to be subject to the contract under which a party other than the City agrees to place a sewer line along the east side of Lot 26, Block 1, Jackson Woods Unit 2, from the stub out behind the curb to the north property line of said Lot 26, Block 1, Jackson Woods Unit 2, and to the owners of the above described property waiving any claims against the City of Corpus Christi by virtue of construction, operation and mainte- nance of said sewer line. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect°any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity. would be better served by the closing of the above described portions of easement in Lot 26, Block 1, Jackson Woods Unit 2, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date ' of its introduction but that such ordinance or resolution shall•be read at • three several meetings of the City Council, and the Mayor having declared f that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the3/s4" day of October, 1979. E-3 DATE `a 21-79 JOB NO CIc7.59 DRN: 1' "• CKD_ wxac oxaara r 'ssnaidszt AGREEMENT TO CONSTRUCT 8" SANITARY SEWER LINE FOR AND IN CONSIDERATION of the City of Corpus Christi abandoning the west 2 1/2 feet of sanitary sewer easement through Lot 26, Block 1, Jackson Woods Unit #2, a subdivision in the City of Corpus Christi, Nueces County, Texas, as more specifically described in Ordinance No. 15208 and exhibits attached thereto, adopted by the City Council on October 31, 1979, Jcnco Builders, Inc., agrees to construct, within forty-five (45) days from execution hereof, an 8 -inch sanitary sewer line at no expense to the City of Corpus Christi and within the remaining 12 1/2 feet of said easement in, through and upon Lots 26 and 27, Block 1, Jackson Woods Unit 02, a sub- division in Corpus Christi, Nueces County, Texas, as shown on the attached exhibit, marked "A". Plans and specifications for construction of said line shall be approved by the City of Corpus Christi prior to the start of con- struction. During and upon completion of construction, the line shall be subject to inspection and acceptance by the City of Corpus Christi. As additional consideration for said abandonment, Jonco Builders, Inc., agrees to and does hereby indemnify the City of COrpUS Christi against any claim arising out of the construction of said sanitary sewer by Jonco Builders, Inc. BREWSTER AND WIFE, BETTY M.
