HomeMy WebLinkAbout15230 ORD - 11/14/1979nh:11-13-79:1st AN ORDINANCE CLOSING A PORTION OF JOHANNA STREET LOCATED ON LOT 46, BLOCK 3, VENTURA PLAZA UNIT 5, AS MORE PARTICU- LARLY DESCRIBED HEREINAFTER; PROVIDING FOR SEVERA- BILITY; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a public hearing concerning the closing of a portion of dedicated Johanna Street, located on .what is now described as Lot 46, Block 3, Ventura Paza Unit 5, situated in the City of Corpus Christi, Nueces County, Texas, was given by publication and mail to the last known addresses of the owners of abutting property proposed to be closed and within 450 feet of the area to be closed, and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting by the City Council of the City of Corpus Christi on November 7, 1979, in accordance with the provisions of the City Charter; and WHEREAS, it has been determined by the City Council after such hearing that the portion of Johanna Street proposed to be closed is not needed now, nor will it be within the foreseeable future needed as a public street: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the portion of Johanna Street, located on what is now described as a portion of Lot 46, Block 3, Ventura Plaza Unit 5, situated in the City of Corpus Christi, Nueces County, Texas, more fully described hereinafter, be and the same is hereby closed for public use and . abandoned to the abutting property owners: Being a 25.00 feet by 31.20 feet tract of land out of Lot 46, Block 3, Ventura Plaza Unit 5, a map of which is recorded in Volume 44, page 161, 162, Map Records of Nueces County, Texas; BEGINNING at a 5/8 inch iron rod set on the Northwest i' ,- right-of-way line of Bonham Street for the East corner of this tract; �O THENCE South 29°00'00" West, with said Northwest right am: of -way, along the Southeast lot line of Lot 46, 25.00 Q feet for the South corner of this tract; THENCE North 61'25'20" West 31.20 feet for the West corner of this tract; THENCE North 29°00'00" East 25.00 feet to a point on the Northeast line of said Lot 46 for the North corner of this tract; 15230 THENCE South 61°25'20" East, along said Northeast line of Lot 46, 31.20 feet to the POINT OF BEGINNING, con- taining 780.00 square feet of land. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the hereinabove described portion of Johanna Street creates a public emergency and an imperative public neces- sity requiring the suspension of the Charter rule that no ordinance or reso- , lution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordin- ance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the li-day of November, 1979.
