TENNIS COURT IMPROVEMENTS' PROJECT), TO PROVIDE FOR THE REHABILITATION OF FIG STREET FROM TARLTON STREET TO SHELY STREET AND THE COSTS INCURRED IN THE REDESIGN OF THE LARGE PARKING LOT; APPROPRIAT- ING $30,093.66 OUT OF THE NO. 220 STREET BOND FUND ($25,995.30 FOR CHANGE ORDER NO. 1 FOR FIG STREET AND $4,098.36 FOR CHANGE ORDER NO. 2 FOR THE PARKING LOT) APPLICABLE TO PROJECT NO. 220-77-23, SHELY STREET REALIGNMENT; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, • TEXAS: SECTION 1. That the City Manager be authorized to execute Change Order Nos. 1 and 2 to the contract with APCCO for the realignment of Shely Street (being done in conjunction with the H.E.B. Tennis Court Improvements Project), to provide for the rehabilitation of Fig Street from Tarlton Street to Shely Street and the costs incurred in the redesign of the large parking lot, all as more fully set forth in the Change Order Nos. 1 and 2, a sub- stantial copy of each being attached hereto as Exhibits "A" and "B". SECTION 2. That there is hereby appropriated out of the No. 220 Street Bond Fund the sum of $30,093.66, $25,995.30 being for Change Order No. 1 for Fig Street and $4,098.36 for Change Order No. 2 for the parking lot, applicable to Project No. 220-77-23, Shely Street Realignment. SECTION 3. The necessity to authorize execution of the aforesaid change orders at the earliest practicable date and to appropriate the sums necessary to accomplish the work proposed by the said change orders creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall he read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the sus- pension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from 15252 and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 5 day of December, 1979.
