AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER
NOS. 1 AND 2 TO THE CONTRACT WITH APCCO FOR THE RE-
ALIGNMENT OF SHELY STREET (BEING DONE IN CONJUNCTION
WITH THE N.E.B. TENNIS COURT IMPROVEMENTS' PROJECT),
TO PROVIDE FOR THE REHABILITATION OF FIG STREET FROM
TARLTON STREET TO SHELY STREET AND THE COSTS INCURRED
IN THE REDESIGN OF THE LARGE PARKING LOT; APPROPRIAT-
ING $30,093.66 OUT OF THE NO. 220 STREET BOND FUND
($25,995.30 FOR CHANGE ORDER NO. 1 FOR FIG STREET AND
$4,098.36 FOR CHANGE ORDER NO. 2 FOR THE PARKING LOT)
APPLICABLE TO PROJECT NO. 220-77-23, SHELY STREET
REALIGNMENT; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, •
TEXAS:
SECTION 1. That the City Manager be authorized to execute Change
Order Nos. 1 and 2 to the contract with APCCO for the realignment of Shely
Street (being done in conjunction with the H.E.B. Tennis Court Improvements
Project), to provide for the rehabilitation of Fig Street from Tarlton Street
to Shely Street and the costs incurred in the redesign of the large parking
lot, all as more fully set forth in the Change Order Nos. 1 and 2, a sub-
stantial copy of each being attached hereto as Exhibits "A" and "B".
SECTION 2. That there is hereby appropriated out of the No. 220
Street Bond Fund the sum of $30,093.66, $25,995.30 being for Change Order
No. 1 for Fig Street and $4,098.36 for Change Order No. 2 for the parking
lot, applicable to Project No. 220-77-23, Shely Street Realignment.
SECTION 3. The necessity to authorize execution of the aforesaid
change orders at the earliest practicable date and to appropriate the sums
necessary to accomplish the work proposed by the said change orders creates
a public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution shall
he read at three several meetings of the City Council, and the Mayor having
declared that such emergency and necessity exist, having requested the sus-
pension of the Charter rule and that this ordinance be passed finally on the
date of its introduction and take effect and be in full force and effect from

and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 5 day
of December, 1979.

7. 4' Concrete Sidewalk 5008 SF @ 1.65 = 8,263.20
8. Concrete Driveway - 460 SF @ 3.65 = 1,679.00
9. Standard 5' Inlet 1 EA @ 725.00 = 725.00
0. 15" R.C.P. 16 LF @ 14.50 = 232.00
TOTAL $25,995.30
Remove existing head -in parking area @ Sta. 2+00 Lt. to Sta. 4+00 Lt. and backfill
and grade area as subsidiary to this change order. Add 12 working d,ys.

1. Add payment for backfill of previous excavation
at $2.12 per S.Y. 1,200 S.Y.
2. Add payment for 131 L.F. of curb and gutter removal @ $2.60
per L.F.
3. Add payment for removing 550 S.F. of existing 10' concrete
sidewalk @ $o.82 per S.F.
4. Add payment for removing 168 S.F. of existing 4' concrete
sidewalk @ $0.82 per S.F. -
5. Add 75 L.F. of gravity curb around existing trees @ $4.00/L.F.
6. Add $125.00 for the modification of an existing inlet at the
west end of proposed parking lot.
7. Adjust east fence of 5 court battery and west fence of 3 court
battery as per the attached sketches for luno sum price of
$200.00. The adjustment would be deleting 145 L.F. of a 10'.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
