HomeMy WebLinkAbout15255 ORD - 12/05/1979vp:12/3/79:1st AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF HARBOR VILLAGE ' BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON 29.406 ACRES OF LAND OUT OF LOTS 1, 2, SEC.30 AND LOTS 2,3, SEC. 31, FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS, SITUATED IN THE CITY OF CORPUS CHRISTI NUECES COUNTY, TEXAS, FROM "A-1" APARTMENT HOUSE DISTRICT AND "B-4" GENERAL BUSINESS UfSIRiel IU "R -1B" ONE-rAr1ILY DWELLING UIS[RILI ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN' EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Harbor Village for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the. City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, December 5 , at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same—i-s-hereby amended by making the change hereinafter set out. _3X25 SECTION 2. That the following described tract or parcel of land, being out of Lots 1 and 2, Section 30, and Lots 2 and 3, Section 31, Flour Bluff & Encinal Farm & Garden Tracts, situated in the City of Corpus Christi, Texas, be and the same is hereby changed from "A-1" Apartment House District and "B-4" General Business District to "R -1B" One -family Dwelling District, said property being more particularly described as follows: Being a tract or parcel containing 29.406 acres of land out of Lots 1 and 2, Section 30 and Lots 2 and 3, Section 31, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume "A", Pages 41, 42 and 43, Map Records of Nueces County, Texas: BEGINNING at the Southeast corner of this,survey .from which cor- ner the Southwest corner of Lot 5B, Block 1, South Bay Addition Unit 1, a map of which is recorded in Volume 39, Page 24, Map Records of Nueces County, Texas, bears North 29°00.00" East 8.89 feet; THENCE North 61°00'00" West 292.91 feet for an inside corner of this Survey; THENCE South 29°00'00" West 8.00 feet for a corner of this survey; THENCE North 61°00'00" West 259.80 feet to a point on the East boundary line of Anchor Harbor Tract No. 1, a map of which is recorded = in Volume 30, Page 83, of said Map Records for the Southwest corner of this survey; THENCE North 29'01'23" East, along the aforementioned East boun- dary line 491.77 feet to the Southwest corner of a 5.0' x 30.0' tract of land conveyed to the City of Corpus Christi by Eda Mary Lee, recorded in Volume 1118, Pages 284, 285, Deed_Records of Nueces County, Texas, for a corner of this survey;' THENCE South 60°58'37" East, along the South boundary line of said 5.0' x 30.0' tract, 5.00 feet ,for the Southeast corner of said tract and an inside corner of this survey; THENCE North 29°01'23" East, along the East boundary line of the aforementioned tract, 30.00 feet for the Northeast corner of said tract and an inside corner of this survey; THENCE North 60°58'37" West, along the North boundary line of said 5.0' x 30.0' tract, 5.00 feet to a point on said East line of Anchor . Harbor Tract No. 1 for a corner of this survey; - THENCE North 29°01'23" East, along said East line of Anchor Harbor Tract No. 1, 749.86 feet to an iron rod found for the Northeast corner of said Anchor Harbor Tract No. 1 and an inside corner of this survey; THENCE North 61°00'00" West, along the North boundary line of said Anchor Harbor Tract No. 1, 165.17 feet for a corner of said Tract No. 1 and a corner of this survey; THENCE with the meanders of Cayo Del Oso, as follows: North 51°17'00" East 180.00 feet to a point; North 40°36'00" East 242.65 feet to a point; North 29°42'40" East 105.56 feet to a point; North 17°21'00" East 200.00 feet to a point; and North 06°42'00" East 155.00 feet to a point for the Northwest cor— ner of this survey; THENCE continuing with said meanders of Cayo Del Oso, as follows: South 73°33'00" East 180.29 feet to a point; South 56°48'05" East 18.39 feet to a point; South 58°47'36" East 77.70 feet to a point; South 66°46'00" East 298.12 feet to a point; and South 80°58'39" East 34.10 feet to a 3/4 inch iron pipe found for the Northwest corner of a 4.21 acre tract designated as Park out of South Bay Addition Unit 1, a map of which is recorded in Volume 22, Page.48 of said Map Records and the Northeast corner of this survey; THENCE South 29°00'00" West, along the West subdivision line of the aforementioned South Bay Addition Unit 1, at 2,202.00 feet pass the Southwest corner of said Unit 1 same being said Southwest corner of Lot 5B, Block 1, in all a distance of 2,210.89 feet to the POINT OF BEGINNING SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 5 day of „taa m, 19 '7% . TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally,on the date it is introduced, or at the present meeting of the City Council.
