AN ORDINANCE ,
AMENDING ORDINANCE NO. 13168, PASSED AND APPROVED,ON
MAY 5, 1976, RETROACTIVELY TO SEPTEMBER 1, 1979, SO AS
TO INCREASE THE MINIMUM AGE FOR PARTICIPATION FROM 50
TO 55; PROVIDING FOR SEVERABILITY; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That Ordinance No. 13168, passed and approved on
May 5, 1976, be amended retroactively to September 1, 1979, by amending
Sections 1 and 2 to hereafter read as follows:
"Section 1. There is hereby established the City of Corpus Christi
Retirement Plan for employees entering employment with the City of Corpus ,
Christi over age 54, and not otherwise covered or eligible for coverage
under the Texas Municipal Retirement System.
"Section 2. Participation in such fund shall be optional with the
employee, except as limited hereinafter. Only those employees over age 54
and not otherwise covered or eligible for coverage under the Texas Municipal
Retirement System, when employed, shall be eligible to participate. Employees
over the age of '54 hired after September 1, 1979, must participate inthis
plan. Present employees, hired over the age of 54 years, and not otherwise
covered or eligible for coverage under the Texas Municipal Retirement
System must elect to participate in this plan, if they desire to do so,
within a period of 60 days of the effective date of this ordinance. Once
an employee elects to participate, his decision is final, and he may not
later withdraw. If an employee fails to elect to participate within the
60 -day period mentioned hereinabove, he shall be presumed to have elected
not to participate. This decision is also final."
SECTION 2. `The necessity to amend the City of Corpus Christi
"Over Age 50 Retirement Program" creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule that no ordi-
nance or resolution shall be passed finally on the date of its introduction
but that such ordinance or resolution shall be read -at three several meetings
of the City Council, and the Mayor having declared that such emergency and
necessity exist, having requested the suspension of the Charter rule and that
this ordinance be passed finally on the date of its introduction and take

effect and be in full force and effect from and after its passage, IT IS
ACCORDINGLY SO ORDAINED, this the / ! day of December, 1979.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
