HomeMy WebLinkAbout15271 ORD - 12/19/1979vp:12/18/79:1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH CACTUS UTILITY COMPANY FOR CONSTRUCTION OF THE FLOUR BLUFF SANITARY SEWER IMPROVEMENTS; APPROPRIATING $215,000 OF WHICH $90,139.97 IS OUT OF THE NO. 250 SANITARY SEWER BOND FUND AND $124,860.03 IS OUT OF THE 5TH YEAR COMMUNITY DEVELOPMENT BLOCK GRANT, NO. 162 FEDERAL/STATES GRANT FUND, ACTIVITY 4744, CODE 502, OF WHICH TOTAL APPROPRIATION $194,654.80 IS FOR THE CONSTRUCTION CONTRACT AND $20,345.20 IS FOR ADDITIONAL ENGINEERING, CONTINGENCIES, LABORATORY TESTING, LEGAL ADVERTISING, INCIDENTAL AND RELATED EXPENSES, APPLICABLE TO PROJECT NO. 250-77-11, FLOUR BLUFF GARDENS LIFT STATION AND LATERALS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute a contract with Cactus Utility Company for construction of the Flour Bluff Sanitary Sewer Improvements, all as more fully set forth in the plans and specifi- cations and contract documents on file in the office of the City Secretary, all of which are made a part hereof by reference and according to the bid of Cactus Utility Company, opened on the 12th day of December, 1979, said bid being the lowest and most advantageous to the City of Corpus Christi, Texas. SECTION 2. That there is hereby appropriated the sum of $215,000 of which $90,139.97 is out of the No. 250 Sanitary Sewer Bond Fund and $124,860.03 is out of the 5th year Community Development Block Grant, No. 162 Federal/States Grant Fund, Activity 4744, Code 502, of which total appropri- ation $194,654.80 is for the construction contract and $20,345.20 is for additional engineering, contingencies, laboratory testing, legal advertising, incidental and related expenses, applicable to Project No. 250-77-11, Flour Bluff Gardens Lift Station and Laterals. SECTION 3. That the necessity to execute the aforesaid contract and to appropriate the sums hereinabove set out so that the various improve- ments may be made to the Flour Bluff Sanitary Sewer at the earliest practicable creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor rBrvf J�.1i ICROFILMED AUG?c,) having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of December, 1979.
