HomeMy WebLinkAbout15278 ORD - 12/19/1979jkh:12-19-79;lst si AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE CONTRACT WITH LOCKWOOD, ANDREWS & NEWNAM, INC., FOR ENGINEERING SERVICES TO BE PERFORMED AT THE CORPUS CHRISTI INTERNATIONAL AIRPORT, A SUBSTANTIAL COPY OF WHICH AMENDMENT IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A", WHICH PROVIDES FOR ADJUSTED DESIGN FEES RESULTING FROM INCREASED CONSTRUCTION COSTS AND FOR INTERIM PAYMENTS DURING THE DESIGN PHASE; APPROPRIATING AN ADDITIONAL $48,285 OUT OF THE NO. 245 AIRPORT BOND FUND FOR ADDITIONAL ENGINEERING FEES BASED ON DESIGN CHANGES, OF WHICH $34,125 IS APPLICABLE TO COMMERCIAL RAMP OVERLAY, PROJECT NO. 245-77-1; $11,820 IS APPLICABLE TO MAIN PARKING LOT EXPANSION, PROJECT NO. 245-77-2; AND $2,340 IS APPLICABLE TO AIRPORT ENTRANCE ROAD, PROJECT NO. 245-77-5; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute an amendment to the contract with Lockwood, Andrews & Newnam, Inc., for engineering services to be performed at the Corpus Christi International Airport, a substantial copy of which Amendment is attached hereto and made a part hereof, marked Exhibit "A", which provides for adjusted design fees resulting from increased construction costs and for interim payments during the design phase. SECTION 2. That there is hereby appropriated an additional $48,285 out of the No. 245 Airport Bond Fund for additional engineering fees based on design changes, of which $34,125 is applicable to Commercial Ramp Overlay, Project No. 245-77-1; $11,820 is applicable to Main Parking Lot Expansion, Project No. 245-77-2; and $2,340 is applicable to Airport Entrance Road, Project No. 245-77-5. SECTION 3. BRUCE AYCOCK, CITY ATTORNEY By /2 12 City Atto MAR THE CITY OF CORPUS CHRISTI, TEXAS THE STATE OF TEXAS COUNTY OF NUECES AMENDMENT TO CONTRACT FOR ENGINEERING SERVICES X 1 The City of Corpus Christi, hereinafter called "City", and Lockwood, Andrews and Newnam, Inc., hereinafter called "Engineer", agree to the following amendment to the contract foreagineering services approved by Ordinance No. 14267 and executed June 17, 1978: 1. Fees for Basic Services The basic fee for performing the basic engineering services for Items 1-A.- Access Road, 1-B - Parking Lot, and 1-C - Commercial Ramp is adjusted as follows: Project Phase Construction Contract Original Adjusted Budget Section Contract Fee Access Road $ 195,000.00 3.A.1. $15,360.00 $17,700.00 .Parking Lot -Loop Road & Related Work $ 513,000.00.___ 3.A.2 $31,280.00 $43,100.00 Commercial Ramp $1,320,000.00 - 3.A.3 $48,575.00 $82,700.00 2. Payment of Fees for Basic Services The City and the Engineer agree that Section 3.B.2 be changed as follows: For services rendered under the design phase as described in the original contract and as amended herein an amount equal to 65% of the basic fee. for work authorized by the City shall be due and payable. Of this amount 85% shall be paid to the Engineer upon submittal to the City of approximately 95% complete plans and specifications. Ten percent (10%) of this amount shall be paid upon completion of all remaining portions of Items 1; 2, and 3 of Section 2.B of. the engineering contract. The final 5% of this amount shall be paid upon completion of Items 4, 5, and 6 of Paragraph 2.B upon contract award, except that in the event; the City does not award a contract within 90 days after approval of plans and specifications, then the remaining 5% will be due and payable 90 days after the approval of the plans and specifications by the City. 3. The City and the Engineer agree to add the following section to the_ Engineering Contract: SECTION 10: Revisions of Plans and Specifications The Engineer agrees that the design of each of the projects shall be such that the estimated cost thereof prior to the receipt of bids will not exceed the above construction budget. In the event that the low bid exceeds the construction budget, the City may desire to make modification Corpus Christi, Texas I Q day of (_ oin< r rat V) , 19 —1 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
