HomeMy WebLinkAbout15283 ORD - 12/26/1979jkh:12-26-79;lst AN ORDINANCE APPROVING AN EASEMENT AND RIGHT-OF-WAY AGREEMENT BETWEEN THE LOWER NUECES RIVER WATER SUPPLY DISTRICT AND CENTRAL POWER AND LIGHT COMPANY FOR THE MAINTE- NANCE OF ELECTRICAL SERVICE LINES TO THE CITY OF MATHIS RAW WATER INTAKE STRUCTURE AT LAKE CORPUS CHRISTI, ALL AS MORE FULLY SET FORTH IN THE SAID EASEMENT AND RIGHT-OF-WAY AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That approval is hereby given on behalf of the City of Corpus Christi for an easement and right-of-way agreement between the Lower Nueces River Water Supply District and Central Power and Light Company for the maintenance of electrical service lines to the City of Mathis raw water intake structure at Lake Corpus Christi, all as more fully set forth in the said easement and right-of-way agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. The necessity to approve the described easement and right-of-way agreement at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or -resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the sus- pension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 26th day of December, 1979. P. and J. N. Delgado grant, San Patricio County, Texas, part of said easement being out of a 164.89 acre tract conveyed from the City of Corpus Christi to the Lower Nueces River Water Supply District by deed dated December 1, 1953, and recorded in Volume 501, p. 12, of the Deed Records of Nueces County, Texas, and the remaining part of said easement being out of a 51.9 acre tract described in a deed from Howard Denison, et. ux., to the Lower Nueces River Water Supply District dated September 12, 1955, and recorded in Volume 204, p. 446, of the Deed Records of San Patricio County, Texas. Said easement is more fully shown on the attached ex- hibits r"Art and "B". Together with the right of ingress and egress, over, under, across and upon said land and Grantor's adjacent land for the purpose of constructing, operating, reconstructing on poles or metal towers, burying and replacing underground cables and conduits (including necessary ditching and backfilling), enlarging, inspecting, patrolling, repairing, maintain- ing, and removing said lines, circuits, underground cables and conduits, poles, metal towers, wires and appurtenances; the right to relocate along the same general direction of said lines, cables, and conduits; and the right to remove from said lands all trees and parts thereof, or other obstructions, which endanger or may interfere with the safety and efficiency of said lines, cables or conduits, or appurtenances. Grantor reserves the right to use the land subjected to said easement and right of way in any way that will not interfere with Grantee's exercise of the rights hereby granted. r TO HAVE AND TO HOLD the above described easement and rights unto the Grantee, its successors and assigns, until all of said lines shall be abandoned and removed.
