ORDERING AN ELECTION TO BE HELD JOINTLY WITH NUECES
COUNTY WITHIN THE CITY OF CORPUS CHRISTI, TEXAS, FOR
THE PURPOSE OF DETERMINING WHETHER OR NOT CERTAIN
TERRITORY ADJACENT TO THE CITY OF CORPUS CHRISTI AS
MORE FULLY DESCRIBED BY LOTS AND BLOCKS OR METES AND
BOUNDS ON FILE IN THE OFFICE OF THE CITY SECRETARY, AND
MADE A PART HEREOF BY REFERENCE THE SAME AS IF COPIED
VERBATIM HEREIN, SHALL BE ANNEXED TO THE CITY OF CORPUS
CHRISTI; DEFINING THE TERRITORY TO BE ANNEXED; PROVIDING
PROCEDURE FOR THE HOLDING OF SUCH ELECTION; PRESCRIBING
THE FORM OF NOTICE OF ELECTION; PROVIDING FOR PUBLICA-
TION THEREOF; PROVIDING FOR FORM OF BALLOT AT EACH
POLLING PLACE; ENACTING PROVISIONS INSTANT TO AND
RELATING TO THE PURPOSE OF THIS ORDINANCE; PROVIDING
FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
WHEREAS, the City Council of the City of Corpus Christi desires
to submit to the voters of the City the question of annexation of certain
tracts of land, more fully described herein; and
WHEREAS, pursuant to the Municipal Annexation Act, as amended,
public hearings were held, including hearings within the area proposed to
be annexed, on September 15, 16, and 17, 1981:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That an election be held jointly with Nueces County
on the third day of November, 1981, within the City of Corpus Christi, and
that there be submitted at said election to the qualified voters of said
City the question of whether or not certain territory being described generally
as hereinafter set forth and all as more particularly described by metes and
bounds or lots and blocks and maps or plats thereof on file in the office of
the City Secretary, and made a part hereof by reference the same as if copied
verbatim herein:
AREA A
Nottarb Subdivision off Weber Road, business and industrial
uses on land which was part of Cabaniss Field and the
frontage along Saratoga west of Ayers.
AREA B
Land between Clarkwood Road, the Clarkwood Ditch and
McGloin Road; the San Juan Subdivision; and the area
along the south side of Highway 44 westward to just
west of the extension of Rand Morgan Road;

and north of FM 624 and west of State Highway 77 out to
East Riverview Drive,including the Robstown Riverside
Hospital;

limits line and the Nueces River floodplain.

Land between the Nueces River, the existing City limits,

SECTION 2. That the official ballot for said election shall be,
except for caption and date and other formalities as may be provided by
law for the form of said ballot, as hereinafter set forth, and the proposi-
tion to be voted on at said election and the words appearing on the ballots
shall be as follows:

AREA A

limits, the Allison Wastewater Treatment plant,
McKenzie Road, Carbon Black Plant Road and a

Shall the City of Corpus Christi, by ordinance,
annex to the City of Corpus Christi and its
corporate limits certain additional territory
described generally as follows:
AREA D
Areas which are subdivided and where
construction of physical improvements have been
completed on Padre Island, all as more specifically
described in the ordinance ordering an election
passed October 7, 1981.
SECTION 3. If at said election a majority of the duly qualified
voters who reside within the City of Corpus Christi voting at said election
shall vote in favor of the annexation to the City of Corpus Christi of the
territory and respective areas herein described and referred to herein, and
as generally provided in the respective Annexation Propositions, the City
Council shall, by ordinance, annex and receive such territory and areas,
respectively, as a part of said City, and thereafter such territory and
areas so annexed and received shall be a part of the City of Corpus Christi,
Texas.
SECTION 4. Said election shall be held in the City of Corpus
Christi, Texas, at the following places:

The presiding judges shall be authorized to select such clerks or
other assistants provided by law, as may be deemed necessary and said election
is to be held under authority of City Charter Article I, Sec. 2(a), as amended,
and in accordance with the election laws of the State of Texas, insofar as
they are applicable. The maximum number of judges and clerks at each polling
place shall not exceed five, and the rate of pay shall be established at $4.00
per hour for each judge and clerk, and a fee of $25.00 is established for
judges for delivering election returns.
The polls shall be open from 7:00 o'clock a.m., to 7:00 o'clock
p.m., on the date of the said election.
SECTION 5. Marion Uehlinger, whose office is situated at the
Office of the Nueces County Clerk, Second Floor, Nueces County Courthouse,
901 Leopard, Corpus Christi, Texas, is hereby appointed Election Manager and
Judge of said election, and she is hereby authorized and directed to make
all necessary arrangements for the holding of said election in accordance
with and subject to the laws of this State, and the said Marion Uehlinger
and Bill G. Read are appointed to hold such election, in accordance with
Article 2.Olc of the Texas Election Code. The expenses of said joint elec-
tion shall be divided proportionately.
SECTION 6. Voting machines shall be used for the conduct of said
election on electim day and for conducting absentee voting, except that for
absentee votes cast by mail, paper ballots shall be used. Absentee voting in
person shall be conducted in the Absentee Voting Room on the First Floor of
the Nueces County Courthouse, 901 Leopard, Corpus Christi, Texas, from
8:00 a.m. to 5:00 p.m., Monday through Friday, beginning on October 14, 1981
and ending October 30, 1981. The following officials shall conduct the
absentee voting:

SECTION 7. An election school will be held for the election
officers in the Cafeteria of the Nueces County Courthouse on Friday, October
30, 1981, at 7:30 p.m.

SECTION 8. A special canvassing board shall be used to count the
absentee ballots, and the following persons are hereby appointed to serve
as such special canvassing board, to -wit:

SECTION 9. The City Secretary is directed to post and publish
such election notices as are required by the Election Laws of the State of
Texas.
SECTION 10. By approving and signing this ordinance, the Mayor
officially confirms as his action all matters recited in the ordinance
which by law come within his jurisdiction.
SECTION 11. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision, proposition or portion thereof shall be
held invalid or unconstitutional by final judgment of a court of competent
jurisdiction, it shall not affect any other section, paragraph, subdivision,
clause, phrase, word, or provision, proposition or portion thereof, for it
is the definite intent of this City Council that every section, paragraph,
subdivision, clause, phrase, word, or provision or proposition hereof be given
full force and effect for its purpose.
SECTION 12. That upon written request of the Mayor or five
Council members, copy attached, to find and declare an emergency due to
the necessity for the governing body of the City of Corpus Christi to order
the aforesaid election and that the notice for such election should be promptly
posted and that a regular City election for the annexation of the territory
hereinabove described shall be held on November 3, 1981, such finding of an
emergency is made and declared requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three regular
meetings so that this ordinance is passed and shall take effect upon first
reading as an emergency measure this the 7th day of October, 1981.
