AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS WITH
NOBLE FOOD SERVICE AND OGDEN FOOD SERVICES CORPORATION OF
TEXAS, WHICH EXTEND THE CONCESSIONS CONTRACTS AT THE
BAYFRONT PLAZA CONVENTION CENTER AND MEMORIAL COLISEUM
RESPECTIVELY UNTIL 2:00 A.M. JUNE 3, 1990; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute an agreement with
Noble Food Service to extend concessions service at the Bayfront Plaza Convention Center
until 2:00 A.M. on June 3, 1990, all as more fully set forth in the agreement, a substantial
copy of which is attached hereto and made a part hereof, marked "Exhibit A"; to execute an
agreement with Ogden Food Services of Texas to extend concessions service at the Memorial
Coliseum until 2:00 A.M. on June 3, 1990, all as more fully set forth in the agreement, a
substantial copy of which is attached hereto and made a part hereof, marked `Exhibit B".
SECTION 2. That upon written request of the Mayor or five Council members, copy
attached, to find and declare an emergency due to the need to extend the concessions
contracts at the Bayfront Plaza Convention Center and Memorial Coliseum at the earliest
practicable date, such finding of an emergency is made and declared requiring suspension of
the Charter rule as to consideration and voting upon ordinances at three regular meetings so
that this ordinance is passed and shall take effect upon first reading as an emergency measure

EXTENDING BAYFRONT CONVENTION CENTER CONn sIONAIRE AGREEMENT
This Letter of Agreement Extending the Bayfront Convention Center
Conn ssionaire Agreement is between Noble Food Service, Inc., ("Concessionaire")
and the City of Corpus Christi ("City").
WHEREAS, the concession agreement, effective at 2:01 a.m., January 1, 1985,
for the Bayfront Convention Center expires at 2:00 a.m., January 1, 1990,
("Agreement"); and
WHEREAS, City is in the process of procuring bids and letting a new
conrrssion agreement for the Bayfront Convention Center; and
WHEREAS, City wants Conrnssionaire to continue operating the Bayfront
Convention Concession until a new concession agreement becomes effective;
NOW, THEREFORE, City and Concessionaire agree as follows:
1. All terms and conditions of the Agreement shall be effective for this
extension period.
2. The extension period shall extend until 2:00 a.m. on June 3, 1990,
subject to earlier termination as set forth herein.
3. City can terminate the extension period by giving Concessionaire
thirty (30) days notice in writing.
4. Concessionaire's liquor license expires January 31, 1990. To
accommodate the City in extending this agreement, Concessionaire has
agreed to renew its liquor license. If Concessionaire is not the
successful propoccr for the new concession agreement, at the
termination of the renewal period City will rebate, or deduct, on a
pro rata basis the amount of the liquor license fee which
Concessionaire was unable to 11se. For example if the agreement is
extended for four months, Concessionaire will receive a rebate or

deduction for the eight months of the liquor license Concessionaire
will be unable to ug,..
Once the agreement is terminated
Concessionaire will give up or void its liquor license for the
Bayfront Convention Center, if it is not the successful propoccr for
the new concession agreement. If Concessionaire is the successful
proposer no rebate or deduction will be allowed.

EXTENDING COLISEUM CONCESSIONAIRE AGREEMENT
This Letter of Agreement Extending the Coliseum Concessionaire Agreement is
between Ogden Food Service of Texas, a wholly owned subsidiary of Ogden Allied
Services Corporation ("Concessionaire") and the City of Corpus Christi ("City").
WHEREAS, the concession agreement, effective at 12:01 a.m., May 1, 1988,
for the Coliseum expires at 2:00 a.m., January 1, 1990, ("Agreement"); and
WHEREAS, City is in the process of procuring bids and letting a new
concession agreement for the Coliseum; and
WHEREAS, City wants Concessionaire to continue operating the Coliseum
Concession until a new concession agreement becomes effective;
NOW, THEREFORE, City and Concessionaire agree as follows:
1. All terms and conditions of the Agreement shall be effective for this
extension period.
2. The extension period shall extend until 2:00 a.m. on June 3, 1990,
subject to earlier termination as set forth herein.
3. City can terminate the extension period by giving Concessionaire
thirty (30) days notice in writing.

TO THE MEMBERS OF THE CITY COUNCIL

For the reasons set forth in the emergency clause of the foregoing
ordinance an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances at three regular
meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance finally on the date it is introduced, or at
the present meeting of the City Council.
