AUTHORIZING THE EXECUTION OF A DEMOLITION AGREEMENT WITH
SHAMROCK SITE PREPARATION, INC. FOR THE DEMOLITION OF CITY
OWNED PROPERTY AT 1801 MESQUITE STREET AND 1509 MESQUITE
STREET; APPROPRIATING $4,500.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the City Manager is hereby authorized to
execute a Demolition Agreement with Shamrock Site Preparation, Inc.
for the demolition of City -owned property at 1801 Mesquite Street and
1509 Mesquite Street, all as more fully set forth in the Demolition
Agreement, a substantial copy of which is attached hereto and made a
part hereof, marked Exhibit A.
SECTION 2. That there is hereby appropriated $4,500 from
the Economic Development Trust Fund (EDTF) (243.54).

This DEMOLITION AGREEMENT entered into by and between the CITY OF
CORPUS CHRISTI, TEXAS, a municipal corporation [hereinafter referred
to as "CITY"] and SHAMROCK SITE PREPARATION, INC. [hereinafter
referred to as "CONTRACTOR"] for demolition of TWO (2) COMMERCIAL
STRUCTURES LOCATED AT 1509 MESQUITE AND ONE (1) CEMENT BLOCK BUILDING
LOCATED AT 1801 MESQUITE AS SHOWN ON THE ATTACHED PROPOSAL MARKED
EXHIBIT "A" and made a part hereof for all purposes.
W ITNESSET H:
1. The CITY hereby contracts with the CONTRACTOR to demolish the
improvements and clear certain described real property in accordance
with the specifications more fully described attached as Exhibit "B"
and incorporated herein by reference. The CONTRACTOR agrees to do all
work as provided in said specifications and shall do such additional
work as may he considered necessary to complete the work in a
satisfactory and acceptable manner. The CITY reserves the right to
make such changes in the specifications and in the character of the
work as may be necessary or desirable to insure completion in the most
satisfactory manner. The CONTRACTOR shall furnish all labor, tools,
materials, machinery, equipment and incidentals necessary to the
prosecution of the work unless otherwise provided by the written terms
of the specifications.
2. In consideration of the completion of the above described
work, the CITY agrees to pay to CONTRACTOR the sum of $3,300.00 FOR
ITEM NUMBER 1 OF THE PROPOSAL AND $850.00 FOR ITEM NUMBER 4 OF THF
PROPOSAL. Said payment shall he conditioned upon the acceptance of

the work by the CITY as certified by its final inspection following
receipt of notice from the CONTRACTOR that the work is completed
the
and ready for acceptance. Upon completion at the work and before
acceptance and final payment wi11 he made, the CONTRACTOR shall clean
and remove from the worksite all surplus and discarded materials, and
debris of every kind in order to leave the worksite in a neat, orderly
condition.
3. All work shall he performed in a workmanlike manner and to
the satisfaction of the CITY. The CITY shall determine any rate of
progress of the work and interpretation of the specifications.
4. The CONTRACTOR agrees to indemnify and forever save harmless
the CITY, its officers, agents
lawsuits, claims, demands, Liabilities, losses
and employees from any and all
and expenses, including
for or on account of any injury to
court costs
and attorney's fees,
any person, or death at any time resulting from such injury, or any
damage to property, which may arise or which may be alleged to have
arisen out of or in connection with CONTRACTOR'S activities under this
AGREEMENT. CONTRACTOR agrees to secure and maintain at its own
expense throughout the term of
of insurance set forth in Exhibit "C" attached hereto and incorporated
herein by reference. On each policy the CITY shall be named as an
additional insured and certificates of insurance for all such policies
shall he furnished to the CITY and maintained throughout the term of
this AGREEMENT. Each certificate must provide for thirty [30] days

6. This AGREEMENT or the work provided hereunder may not be
assigned or subcontracted by CONTRACTOR without the prior written
permission of the CITY.
7. Demolition shall he completed within 5 working days after
authorization to proceed.
8. 1T IS UNDERSTOOD THAT THIS AGREEMENT 1S NOT BINDING UNTIL
EXECUTED BY THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI.

SPECIFICATIONS
DEMOLITION AND REMOVAL, OF CITY OWNED PROPERTY
The following items are to be complied with:
1. Disconnect and properly cap or seal -off all
utilities.
2. Remove entire structure, or structures, including
foundations. Fill all holes caused by the contractor.
Leave the area in a rake -clean condition.
3. Remove all loose paper and other debris, including
lumber, etc.
4. Remove all other loose equipment, boxes,
containers, etc. from premises.
5. The area between the front line and the roadway
will be included in the clean-up.
6. None of the materials pertaining to the foregoing
may be sold, placed, or otherwised located on adjoining
properties unless permission is given in writing by the
Property and Land Acquisition Division of the City of Corpus
Christi.
7. All salvage becomes the property of the successful
bidder, but must be removed from the premises.
8. PROTECTION OF THE PUBLIC.
Prior to beginning preparation of the structure for
demolition the contractor who will be performing the work
must install barricading or secure fencing around the work
area to protect the public from accidental injury either by
the proximity of the work area to public areas or as a
result of the creation of an attractive nuisance.
Protective devices will be of a type approved in advance by
the Property and Land Acquisition Division based upon the
specific situation. Barriers shall not be removed until
directed by the Property and Land Acquisition Division.
9. In the event of accidents of any kind, the
contractor shall furnish the City with copies of all reports
of such accidents.

POLICIES OF INSURANCE
Before commencing work the contractor and
subcontractor, if applicable, shall furnish the City's
Property and Land Acquisition Division certificates of
insurance coverage in the following amounts:
(1) Workmen's Compensation (as required by applicable
laws)
(2) Comprehensive General Liability
(a)

This coverage to include cars and trucks owned, rented,

contract.

The contractor and his insurance carrier agrees to
indemnify, save harmless and defend the City of Corpus
Christi, its agents, and servants and employees and each of
them against and hold it and them harmless from any and all
lawsuits, claims, demands, liabilities, losses and expenses,
including court costs and attorneys' fees, for or on account
of any injury to any person, or any death at any time
resulting from such injury, or any damage to any property,
which may arise or which may be alleged to have arisen out
of or in connection with the work covered by this contract.
The foregoing indemnity shall apply except if such injury,
death or damage is caused directly by the negligence or
other fault of the City of Corpus Christi, its agents,
servants, or employees or any other person indemnified
hereunder.
