HomeMy WebLinkAbout020887 ORD - 03/06/1990AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF SHORELINE VENTURE, LTD. BY GRANTING A SPECIAL COUNCIL PERMIT FOR TWO (2) 32 SQUARE FOOT SIGNS, 3 FEET IN HEIGHT IN LIEU OF ANY ADDITIONAL FREESTANDING SIGNS ON THE EAST 1/2 OF WATER BLOCK 8A (8A), BEACH PORTION OF CORPUS CHRISTI; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Shoreline Venture, Ltd. for amendment to the zoning map of the City of Corpus Christi. WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, March 6, 1990, during a meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: CITY OF Christi, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on the East 1/2 of Water Block 8A (8A), Beach Portion of Corpus Christi, as described in the metes and bounds description attached hereto as Exhibit A, situated in the City of Corpus Christi, Nueces County, Texas, for two (2) 32 square foot signs, 3 feet in height, in lieu of any additional freestanding signs, as per the approved site plan, a copy of which is attached hereto as Exhibit B, and subject to all other considerations of B-2 Bayfront Business District. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. ORD-RES\90016 1 MICROFILMED SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall take effect upon firt reading as an emergency measure this the day of ,r1l 19( . This tract is more particularly described by metes and bounds as follows: Beginning at a point in the north right of way line of Taylor Street for the most southerly southeast corner of said Water Block 8A and the most southerly southeast corner of this tract, from which a 1- 1/ 2" iron pipe bears North 89° 32' 00" East, 9.92 feet; THENCE: South 89° 32' 00" West, with said north right of way of Taylor Street, 150.08 feet to a point for the southeast corner of the west one-half of said Water Block 8A and the southwest corner of this tract; THENCE: North, with the common boundary between said east one-half and west one-half of Water Block 8A, a distance of 300.00 feet to a point in the south right of way line of Twigg Street for the northeast corner of said west one-half of Water Block 8A and the northwest corner of this tract; THENCE: North 89° 32' 00" East, with said south right of way line of Twigg Street, 149.92 feet to the point of curvature of a circular curve to the right having a central angle of 90° 28' 00", a radius of 10.00 feet, and a tangent length of 10.08 feet, for the most northerly northeast corner of said Water Block 8A and the most northerly northeast corner of this tract, from which a 3/4" iron rod bears North 89° 32' 00" East, 10.08 feet; 3265-001.MBD EXHIBIT "A" NAISMITH ENGINEERS, INC. 1.101 ACRES 47,956 SQUARE FEET EAST ONE-HALF OF WATER BLOCK 8A, BEACH PORTION OF CORPUS CHRISTI THENCE: With said circular curve, in a southeasterly direction, an arc length of 15.79 feet to the point of tangency of said circular curve in the west right of way line of Shoreline Boulevard for the most southerly northeast corner of said Water Block 8A and the most southerly northeast corner of this tract; THENCE: South, with the west right of way line of Shoreline Boulevard, 280.00 feet to the point of curvature of a circular curve to the right having a central angle of 89° 32' 00", a radius of 10.00 feet and a tangent length of 9.92 feet, said point being the most northerly southeast corner of said Water Block 8A and the most northerly southeast corner of this tract; THENCE: With said circular curve, in a southwesterly direction, an arc length of 15.63 feet to a point of tangency of said circular curve and the point of beginning containing within this description 47,956 square feet (1.101 acres) of land, more or less.
