HomeMy WebLinkAbout020893 ORD - 03/27/1990AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF THE TEXAS GENERAL LAND OFFICE BY GRANTING A CHANGE IN ZONING AND A SPECIAL COUNCIL PERMIT ALLOWING A MIXED USE DEVELOPMENT, INCLUDING TRAVEL TRAILER PARKS (TRACTS 2A/B, 3), AN OPEN-AIR RETAIL MARKET, AND SPECIFIC PROVISIONS FOR LANDSCAPING AND SIGNAGE. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Texas General Land Office for amendment to the zoning map of the City of Corpus Christi. WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, March 6, 1990, during a meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the entire 111.53 acre tract, as per attached metes and bounds description attached hereto as Exhibit A, in the City of Corpus Christi, Nueces County, Texas, be changed from "R -1B" One -Family Dwelling and "B-4" General Business District to "B -2A" Barrier Island Business District. That a Special Council Permit be granted, allowing a mixed use development on the entire 111.53 acre tract to include: 1) travel trailer parks on Tracts 2A/2B and 3, in conformance with "T -1A" regulations except waiving the fence requirements of "T-lA", provided however, that the trailer park use \ORD-RES\9Co17 1 MICROFILMED shall expire should the Special Council Permit expire or in any event if a travel trailer park use has not been established within 3 years; 2) open-air retail market on designated Plan Area No. 2 of the Texas General Land Office Master Plan; and 3) such other uses in conformity with the Texas General Land Office's Village Master Plan as modified by this Special Council Permit. That the Special Council Permit is subject to the following conditions: a) Landscaping - Specifically incorporated herein by reference are the Village Master Plan, Project Standards and Features, Site Standard D for landscaping and landscaping features (requirements) delineated under Description: Areas 1 through 7. b) Signage - Specifically adopt Site Standard E for signage under the Village Master Plan, Project Standards and Features except that: 1) Area Allowance: Wall signs, including roof -mounted wall signs, shall not exceed a total of one square foot sign area per one linear foot tenant frontage. Tenant frontage is to be limited to one (1) side of a building, as it is projected to the adjacent private/public roadway or driveway, but not both. For buildings fronting on the Intracoastal Waterway, one additional square foot of wall signage per one linear foot of frontage on the Intracoastal Waterway shall be allowed, up to a maximum of 60 square feet. No more than one roof -mounted sign per building is allowed in all cases. Signs under this allowance must be oriented only to the Intracoastal Waterway. Front footage shall be measured as a straight-line distance from outside corner to outside corner of the building. 2) The number of roof -mounted wall signs shall not exceed one per building regardless of orientation. 3) Monument Signs - A maximum of 20 monument signs not to exceed 3' x 4', except for the entrance monument sign (not ORD-RES\90017 2 to exceed 5' x 8') for Areas 2 through 7, and no freestanding pole sign as follows: Area 1: One (1) sign Area 2: Two (2) signs Area 3 a,b,c,d,: Three (3) signs Area 3e: One (1) sign Area 4: Two (2) signs Area 5: Three (3) signs Area 6: Two (2) signs Area 7: Two (2) signs Subtotal 17 (including 5' x 8' entrance sign) No more than 1 of the 3 additional monument signs may be added to any of the area groupings as defined above. 4) Where Site Standard E is more restrictive than these conditions, it shall prevail. c) Travel Trailer Parks - A Travel Trailer Park be allowed only on Tracts 2A, 2B, and 3 as described in the metes and bounds description, and granting a time period of 3 years to place in use as conditioned. Should travel trailer use not be in place as conditioned within 3 years, this condition/allowance of the Special Permit shall be deemed expired. d) Exempting the travel trailer parks from the standard screening fence requirement and specifically adopting landscaping and fence requirements as outlined under the Village Master Plan description: Areas 3A, B, C, and D, and require compliance with all other provisions of the "T -1A" District regulations. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect.
