HomeMy WebLinkAbout020907 ORD - 04/17/1990AN ORDINANCE CLOSING AND ABANDONING THE 10 FOOT WIDE BY APPROXIMATELY 110 FOOT LONG DRAINAGE EASEMENT BETWEEN LOTS 25 AND 26, BLOCK 11, POINT TESORO UNIT 2 SUBDIVISION; SUBJECT TO THE PROVISIONS LISTED BELOW. WHEREAS, there exists the 10 foot wide by approximately 110 foot long drainage easement between Lots 25 and 26, Block 11, Point Tesoro Unit 2 Subdivision, shown by plat in Volume 35, Pages 20-21, Map Records, Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easements, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That the 10 foot wide by approximately 110 foot long drainage easement between Lots 25 and 26, Block 11, Point Tesoro Unit 2 Subdivision, shown by plat in Volume 35, Pages 20-21, Map Records, Nueces County, Texas, and further described by metes and bounds attached hereto as Exhibit A, be and the same is hereby closed for public use and every municipal purpose, subject to the applicant being responsible for relocating an existing storm sewer within the easement and to the property being replatted at applicant's expense within 180 days of passage of this ordinance. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. ORD-RES\90026 MICROFILMED METES AND BOUNDS DESCRIPTION DRAINAGE EASEMENT TO BE CLOSED LOTS 25 & 26 BLOCK 11 POINT TESORO UNIT 2 PADRE ISLAND - CORPUS CHRISTI Beginning at point on a curve, said point being on the south right of way line of Bullion Court, which is also the north property line of lot 26, 5 feet in an easterly direction from the northwest corner of lot 26. Thence, S 272 16' 48" W, at approximately 70 feet crossing a concrete bulkhead, a distance of 123.34 feet to a point in a curve with a radius of 409.18 feet, a central angle of 274 22' 26" and a tangent length is 99.65 feet. Said point lies in a navigation channel and is the southeast corner of this tract. Thence, in a westerly direction along the curve to the left, at 5 feet passing the common property line between lots 25 and 26, a distance of 10 feet for the southwest corner of this tract. Thence, N 274 16' 46" E, at approximately 53 feet crossing a concrete bulkhead, a distance of 123.02 feet to a point in curve with a radius of 587.54 feet, a central angle of 182 49' 16" and a tangent length of 97.38 feet. Said point lies 5 feet easterly from the P.C. of said curve and is the northwest corner of this tract. Thence, in an easterly direction along said curve to the right, at 5 feet passing the common property line between lots 25 and 26, a distance of 10 feet to a point for the northeast corner of this tract and the place of beginning.
