REGARDING THE OPERATION OF CHOKE CANYON
SPECIAL CONDITION 5.B OF CERTIFICATE
NO. 21-3214.
WHEREAS, Special Condition
Adjudication No. 21-3214 reserves to the
the right to order releases of water from
Christi (CC/LCC) reservoir system for bay

the Choke Canyon/Lake Corpus
and estuary purposes; and
WHEREAS, TWC has ordered, on an interim basis, releases of
30,000 acre-feet in May and 10,000 acre-feet in June 1990 and has
approved the appointment of an advisory committee to assist it in
developing permanent operating procedures relating to Special
Condition 5.B; and
WHEREAS, the City of Corpus Christi (City) is a co-sponsor
with the Nueces River Authority (NRA) of Choke Canyon Reservoir and
owns a seventy-eight percent (78%) undivided interest in Certificate
of Adjudication No. 21-3214; and
WHEREAS, by contracts with the federal government,
bondholders, and the NRA, City has a responsibility to protect the
integrity of Choke Canyon Reservoir as a viable water supply; and
WHEREAS, City recognizes the importance of freshwater
inflows in maintaining bays, estuaries and related marine organisms;
and
WHEREAS, City wishes to help achieve a reasonable balance
between maintaining a reliable water supply for the Coastal Bend and
maintaining the viability of marine life in the associated bays and
estuaries.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That City supports and encourages TWC's
development and ordering of reasonable, fair, and effective permanent
operating procedures to govern releases of water from the CC/LCC
system for bay and estuary purposes in accordance with Special
Condition 5.B of Certificate of Adjudication No. 21-3214.
SECTION 2. That City recommends that TWC's advisory
committee be chaired by a TWC representative and its members include,
with others it may deem appropriate, representatives of Texas Water
Development Board, Texas Parks and Wildlife Department, U. S. Fish and
Wildlife Service, University of Texas Marine Sciences at Port Aransas
and Austin, Texas A & M Marine Sciences at Corpus Christi and College
Station, the Nueces River Authority, the City of Three Rivers, and the
the City of Corpus Christi.

SECTION 3. That City believes that a reasonable, fair, and
effective operational procedure has to consider in a balanced manner
the needs of all who depend upon waters of the CC/LCC system, the
physical limitations of both the system and the resource, and the
feasibility and effectiveness of any operating procedure being
considered and, therefore, urges TWC to charge its advisory committee
with addressing, among other things, the following:
- The specific ecological marine environment to be maintained.
- The latest studies and models available from the Texas Water
Development Board concerning bay and estuary freshwater
requirements.
- Factors influencing the health and viability of the coastal
marine environment other than freshwater inflows.
- Factors influencing salinity levels in Nueces and Corpus Christi
Bays other than freshwater inflows.
- The quantities and timing of stored freshwater releases required
in addition to inflows expected from spills, return flows and
other sources to maintain the marine environment.
- The yield of the CC/LCC system and the effects of such releases
on the dependability of the Coastal Bend water supply.
- The effects of such releases on the freshwater fisheries and
associated recreational facilities at Choke Canyon and Lake
Corpus Christi.
- The effects of such releases on water supply intake structures
at Choke Canyon and Lake Corpus Christi.
- The effects of such releases on the bay and estuaries.
- The physical capability of the reservoir system to supply the
amounts of freshwater inflows required.
- Alternatives for accomplishing the same degree of bay and estuary
protection by methods other than, or in combination with,
releases of stored waters.
- A definition of drought conditions and operational procedures for
drought conditions to protect the public health, safety and
welfare.
- A monitoring program to evaluate the effectiveness of the
reservoir operation procedures recommended.
- Recommendations for modifying the reservoir operation procedures
as needed to insure a reasonable balance between maintaining a
healthy coastal environment and a dependable regional water
supply.
SECTION 4. That City urges TWC to incorporate in its
operational procedures special conditions to address operations during
drought conditions that would assure protection of the health, safety
and welfare of the public served by the CC/LCC system.
