HomeMy WebLinkAbout020934 RES - 06/19/1990A RESOLUTION SUSPENDING THE OPERATION OF PROPOSED RATE SCHEDULES FILED BY CENTRAL POWER AND LIGHT COMPANY FOR A PERIOD OF NINETY (90) DAYS BEYOND THE DATE ON WHICH SUCH SCHEDULES WOULD OTHERWISE GO INTO EFFECT, AND AUTHORIZING PARTICIPATION IN RATE CASE PROCEEDINGS. WHEREAS, Central Power & Light Company ("CPL") did on May 17, 1990, file a schedule of rates for service with the City of Corpus Christi to become effective June 21, 1990; and WHEREAS, after having considered the presentation of CPL, it is the opinion of the City Council of the City of Corpus Christi that such schedule of rates should be suspended for a period of 90 days from the effective date stated in CPL's Statement of Intent as initially filed or hereafter revised, for further study, investigation, presentation of evidence and public hearing; and WHEREAS, a copy of this resolution has been provided CPL. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the operation of the proposed rate schedules of CPL filed with the City of Corpus Christi on May 17, 1990, is hereby suspended for a period of 90 days from the effective date stated in CPL's Statement of Intent as initially filed or hereafter revised, for further study, investigation, presentation of evidence and public hearing. SECTION 2. That the City Manager is authorized to execute the City's Authorization for Participation in rate case proceedings attached hereto as Exhibit A and incorporated herein. MEQ CITY'S AUTHORIZATION FOR PARTICIPATION Yes, our City wishes to participate as a named party with other cities in a joint study of the rate request of Central Power & Light Company filed on May 17, 1990. We authorize the witnesses and attorneys selected by the Steering Committee of such Cities to act on behalf of our city to obtain all information necessary and pertinent, to conduct investigations, present evidence, make filings in our name, negotiate and execute settlement and advise and represent our city with respect to such case, including any appeals from municipal and Public Utility Commission decisions thereon, all as authorized and directed by the Cities' Steering Committee. This authorization may be terminated at any time by written notice. It is specifically understood that our city and each of the other Participating Cities reserve the right to act independently in the exercise of their local regulatory authority.
